Criminal Cases Before the Gentleman Justices:
November 12, 1792 To the Worshipful Court of Botetourt County in Chancery sitting, humbly complaining therewith unto your worshipful your masters; Robert Armstrong, Alexander Armstrong, Thomas Armstrong and Archibald Armstrong;
That our own mother now deceased, in her life time on her passage from the Kingdom of Ireland to America, lost her husband, (our own father) who then possessed of cash and moveable estate to the value of 300 pounds sterling, or thereabouts, which property and money be a nuncupative will was given to our own said Mother to be by her applied to the maintenance and support of her children. That your orators mother first landed in the State of Maryland, where she laid out part of the money aforesaid for the purchase of land which she afterwards disposed of and removed to the County of Augusta, in Virginia; from whence she sent her son Andrew Armstrong, to purchase lands for the use of herself and family and furnished him with the money and credit for that purpose. That the said Andrew did accordingly come to Botetourt County and purchased of a certain John Walker 471 acres in two surveys, also from a certain Israel Christian an entry for land containing 144 acres and adjoining the original purchase around also 152 acres. That the said Andrew Armstrong so contrived as to get title for the aforesaid tracts of land in his own name and never did convey the same or any part thereof to your aforesaid mother in her lifetime, altho after requested thereto and altho the whole of the purchase money was paid by her and purchase made by him exactly agreeable to her directions.
In Answer:
Agreeable to a Didymous from the Worshipfull Courts of Botetourt to us divested as well in behalf of Robert Armstrong and all Devisers of Eleanor Armstrong, Deceased, as in behalf Isabella Armstrong, heiress to Andrew Armstrong, deceased. Personally came before us Michael Johnston of Lawfull age and being qualified and duly sown on the Holy Evangelist, Deposeth saith that before William Armstrong, Husband of the aforesaid decedent, together with her and his family, left Ireland to come to America. The Father of the aforesaid Eleanor had bequathed to Robert and Alexander Armstrong, two of the aforesaid devisers interest in a freehold Ireland, which the aforesaid William and Eleanor sold, which he believes they got something considerable for and on their passage to America, the aforesaid William departed life, being possessed of considerable sum of money, your deponent believes. Soon after their arrival in America, Andrew and David Armstrong, two of the aforesaid decedents sons, purchased a tract of land in Myareland (sic) which said Andrew sold again and then moved to Botetourt where the aforesaid Andrew purchased a tract of land on Roanoak River of Samuel and Joseph Walker; for the sum of two hundred and twenty five pounds and got the titles made to him; and further this deponent saith that he believes and is confident that said Andrew was acting in trust for the whole family and further saith that he has heard the aforesaid Andrew Armstrong often times say that he would never claim one foot of the aforesaid land on Roanoak and further this deponant saith not.
Signed: Michael Johnston (X) his mark

    Does anyone recognize this Armstrong family? I think I might connect here
    somewhere but this is all I have. It would be a big help to have some dates
    for these children. The court records below explain the situation.
