Woods, Samuel - entered service 1776 as lieutenant in Virginia regiment commanded by a Colonel James Wood, & served at Battle of Guilford Courthouse; granted Pension age 85 in Mercer County, Kentucky as Samuel Sr., 1823 [b. abt. 1738] when had wife mentioned but not named but none of their children were living with them; Anthony Crockett made affidavit then age 67 in Franklin County, Kentucky, that he knew soldier during Revolutionary War & verified soldier's Revolutionary War service; Major John Arhold made affidavit then in Madison County, Kentucky, he also knew Revolutionary War soldier & verified soldier's Revolutionary War Service; [omitted reference to a different Samuel Woods born 5/2/1737 that married Sarah Reese]; query letter in file says a Captain Samuel Woods entered service in Albemarle County, Virginia, in 3rd virginia Regiment in Revolutionary War; query letter in 1928 from descendant Mrs. Edwin S.     Mercer Circuit [Kentucky] Sct. April Term 1823
    Samuel Woods Senior produced in court the following Schedule which is ordered to be made of Record and is in the words and figures following, to wit,
    I Samuel Woods Senior do hereby state on oath in order to obtain the Benefit of the late acts of Congress of March 18th 1818, 1st May 1820 & 1st March 1823 providing for Revolutionary Soldiers &c being unable to attend in Court from age and debility that early in the spring of the year 1776 he was commissioned as a Lieutenant and was attached to the 12th Virginia Regiment on Continental Establishment commanded by Colonel James Wood. That he was stationed at Fort Pitt in the year 1776 and was afterwards marched to the South and he was at the Battle of Guilford [March 15, 1781] and continued in the Continental Service in said Regiment for 3 years and then resigned, he further states that he lost his commission by getting wet crossing the Alamance River he further states that after he resigned he served as a militia officer until the war ended at various times when men were called for during the Revolutionary war, he further states that he is now about eighty-five years of age and so reduced in his circumstances that he is unable to work or maintain himself and stands in great need of assistance from his country for support he has a wife old and infirm as himself and no children alive. That he releases all claim to any other Pension from his Government and that he has no other evidence except the evidence of John Galloway which he sent on to the War office in September 1819 when his claim was postponed on account of a mistake in drawing his affidavit in the name of his Colonel which was James Woods, instead of James Wood, the real name his name as an officer of the 12th Virginia Regiment he believes can be found on the roll of the Officers of said State and he hopes that the honorable Secretary of War will not reject his claim when it is apparent from the Records that he was actually in service.

    I James Woods do solemnly swear that I was a resident Citizen of the United States on the 18th day of March 1818 and that I have not since that time by gift, sale or in any manner whatever disposed of my property or any part thereof with intent thereby so to diminish it as to bring myself within the provision of an act of Congress entitled “an act to provide for certain persons engaged in the land and naval service of the United States in the revolutionary war” passed on the 18th day of March 1818, and that I have not nor has any person in trust for me any property, or securities, contracts or debts due to me nor have I any income other than what is contained in the schedule hereto annexed and by me subscribed,

    An Affidavit made in writing and sworn to in court by John Galloway in favor of Samuel Woods for obtaining a Pension is ordered to be certified which affidavit is in the words & figures following, to which, I John Galloway do hereby State on oath that I am well acquainted with Samuel Woods Senior who I saw where his commission as a Lieutenant in the Continental Army at Fort Pitt in the spring of the year 1776 & I saw said Woods sworn to his commission aforesaid and he the said Woods was attached to the same Regiment I was, which was the 12th Virginia Regiment commanded by Colonel James Woods and I know that the said Woods served in the said Regiment as a regular Officer on the Continental establishment for the Term of nearly three years, and I believe he faithfully served his country during that time and was at the Battle of Guilford. Witness my hand this 13th of September 1819

    December Term 1833
    I Anthony Crockett1 at this time aged sixty-seven years do hereby state on oath that I was well acquainted with Samuel Woods (whose affidavit & schedule is herewith annexed) during the Revolutionary war and he was a Lieutenant in the Regiment commanded by Colonel James Wood in the Continental line from Virginia and he continued in service at Fort Pitt & at the mouth of the Kanaway [Kanawha River] in the year 1776 and also was marched to the South and continued in service for more than nine months, said CaptainWoods is now very old and I am informed in a very helpless situation. Witness my hand this 15th day of December 1823.

    The affidavit of Major John Arnold of the County of Madison and State of Tennessee made in writing and sworn to in open court in favor of Samuel Woods for obtaining a pension is ordered to be certified which affidavit is in the words and figures following, to wit
    I John Arnold do hereby state on oath that I am well acquainted with Samuel Woods Senior now of the County of Madison and State of Kentucky – that he was a Lieutenant in the Continental Army (the number of the Regiment not recollected, but believed to be the 12th Virginia Regiment) (neither is the name of the Colonel of said Regiment recollected) that I knew the said James Woods to be in the service at the mouth of the Great Kanhawa [Kanawha] on the Ohio River, where the said Woods & myself served together 15 months or thereabout in the year 1775 and 1776 to the best of my recollection and belief = and I believe said Woods served faithfully during that time and I knew him to be an officer and respected him as such. Witness my hand.
