Will of John Russell of Augusta County and State of Virginia.
I Leave and bequeath to my beloved wife Elizabeth a bed with good and Sufficient furniture a Beaino? a horse Saddle and bridle with Liberty of living in one end of the house I now Live in for the term of During her widowhood also her maintainance of the Land and to be furnished with the other necessarys to make her Life Comfortable during the said term or els[e] the one thereto part of my Estate during her Life.
Second I give and bequeath to my two sons James and Robert the Plantation I now Live on to [be] Equitably divided between them according to Quantity & Quality to them their heirs and assigns forever but I do not allow any of the Land to be sold during my wife's Lifetime without her special Consent, also the sill and vessles to the Joint benefit of the said James and Robert.
Third I Bequeath to my Daughters Ruth Robertson and Nancy Russle to each a bed and furniture one Cow and all their Cloths a horsbeast Saddle and bridle.
Fourth I leave and bequeath to my Grand Daughter Elizabeth a bed and furniture a Cow & her Cloathing also a horse & Least saddle and bridle.
I also allow my Daughters Elzabeth, Nancy and Grand Daughter Elizabeth their Maintainance of the Plantation and Liberty to Live thereon as Long as they Live unmarried.
Fifthly, I leave and bequeath to my two sons James & Robert all the Remainder of my personal estate up on their pai[y]ng the following Legacies Viz: to my Daughter Jammianes [Jameson's?] heirs the sum of five pounds to Elizabeth five pounds to my son John five pounds to Joseph five pounds to Samuel five pounds to Henry Five pounds to my Daughter Hanna, five pounds to Annes Heirs five pounds to Sally five pounds to Nancy, five pounds to Nancy & Ruth five pounds also to pay five pounds to each of my other Children whos names are not here or mentioned or to their heirs also to my Granddaughter Elizabeth five pounds.
And Lastly I hereby Constitute and appoint my wife Elizabeth, and my two sons James and Robert sole Executors of this my Last Will and Testament.

At a Court held for Augusta County January 27th 1817, this Last Will and Testament of John Russell deceased was presented in Court and being proved by the oaths of Joseph Brobeck and David Cunningham two of the witnesses thereto is ordered to be Recorded, Whereupon, The motion of Elizabeth Russell widow and Executrix of said John Russell dec'd, and James Russell and Robert Russell executors of said John Russell dec'd who made oath thereto according to Law and with John B. Christian and Jacob Brobeck their Securities entered into and acknowledged their Bond, in the Penalty of two thousand Dollars conditioned as the Law directs certificate is Granted, them for obtaining probat thereof in due form which Bonds ordered to be Recorded.

  4.   According to the publication "Virginia Soldiers of 1776, Vol I" by Louis A Burgess [found on familysearch.com, URL: https://familysearch.org/eng/library/fhlcatalog/supermainframeset.asp?display=titledetails&titleno=127222&disp=Virginia+soldiers+of+1776 ], on page 440, he lists the following entry:

    "John Russell (1728-1816): Was a Private in 1775 in Captain Peter Gibbs Company, Lancaster Co., Penn. Militia. He was born in Loudon Co, Va. and died in Augusta Co. He married Betsey Smith."

    First, he makes an error in the Captain's name. You find John Russell listed in Captain Peter GRUBBs Company of Lancaster Co, Pa for 1775. You can find this record on fold3.com in their FREE Pennsylvania Archive database - URL: https://www.fold3.com/image/3620190

    Secondly, I think he mistook his wife's name as Smith instead of SWINK. He noted in the preface on page x that his "greatest difficulty has been in the reading of names". He also stated on the same page that he gathered his information from the claims for bounty land retained on file in the office of the Council that were placed in the Archives Department of the State Library.

    If Mr Burgess' information is correct, I question if this John Russell is the son of Andrew Russell Sr since he was born in Loudon County. Also, Andrew Sr would have only been age 12 in 1728 when this John was born. However, it would be beneficial to verify Mr Burgess' information before making any conclusions.
  5.   We find a Will for John Russell abstracted in the "Chronicles of the Scotch-Irish Settlement in Virginia, 1745-1800. Extracted from the Original Court Records of Augusta County, Volume III" by Lyman Chalkley. On page 245 of Volume III which covers Will Book 12, it states as follows:

    "Page 225.-26th September, 1816. John Russell's will-To wife, Elizabeth; sons, James and Robert; daughters, Ruth Robertson, Nancy Russell; to granddaughter, Elizabeth; to daughter, Nancy, and granddaughter, Elizabeth, their maintenance; to daughter, Jammianes' heirs; to Elizabeth; son, John; to Joseph; to Samuel; to Henry; daughter, Hanna; to Anne's heirs; to Sally; to Nancy and Ruth; other children not here named. Executors, wife Elizabeth and sons James and Robert. Teste: W. Wilson, Jr.; Joseph Brobeck (Brucet), Mathew Robertson, David Cunningham. Proved, 27th January, 1817. Executors qualify."
