Disambiguation
James Givens, son of John Givens and Margaret Sittlington, was named as co-Executor in his father's will written 14 January 1790 and served as sole executor when his mother refused to act as co-executor of John Givens' estate. James Givens was clearly an adult in 1790, so he was born prior to 1770. Records from this James Givens have been identified in Jane Tyler Craig Reichlein's The Samuel Givens Family and Kin, written in 1981. She identifies James Givens as being born in January 1764 in Augusta County, Virginia, and he died July 1838 also in Augusta County. He married twice; first to Jane Lyon [a first cousin] on 16 Feb 1804 in Augusta County, and second to Jane Stewart on 3 February 1823 in Rockingham County, Virginia.
Cleek in Early Western Augusta Pioneers mis-identified a different James Givens who died by 1775 in the Revolutionary War as John and Martha [Sittlington] Givens' son, but this is obviously in error based upon his acting as sole executor of his father's estate some 15 years after his death.
Other researchers [including some Ancestry Trees] have mis-identified another James Givens (1764-1832), son of James Givens and Martha Allen, whom is a first cousin of this James Givens.

- James Givens Will in Will Book 22, page 222, written Feb. 7, 1833, proved Augusta Co., Va, December 1838, witnessed by Alexander R. Givens, Zachary Johnston, James Walker. The Givens Farm to be divided between sons, John Givens and Robert Givens, beginning on North side of Middle River upon old Patent Line... thence S.W. thru a small grave yard. [The Samuel Givens Family and Kin" by Jane Tyler Craig Reichlein - 1981].

John Givens' will (Sr.) - - To wife, Margaret; to son, Thomas, 150 acres, part of home plantation; to son, James; to daughter, Mary; to daughter, Sarah Lofftis; daughter, Ann Henderson; son, John; son, George; son, Samuel; son, William; daughter, Elizabeth Lamme; daughter, Margaret Agnew. Executors, wife Margaret, son, James. Teste: D. Stephenson, George and James Crawford. Proved, April 20, 1790, by D. Stephenson and Geo. Crawford. James qualifies. Margaret Givens refuses to execute and nominates son James as sole executor.
- Augusta Co., VA Deed Book 28, pg. 478. Feb. 16, 1796: James Givens of Augusta Co. to Thomas Givens of Augusta Co., 30 acres on South side of Middle River, part of 311 acres, first granted to John Givens by patent Aug. 3, 1743, and by last Will and Testament of John Givens, deceased, was devised to said James Givens, bounded as follows; viz. - Beginning at an ash and an elm by a branch on the Patent Line and comes to his 150 acres tract he now lives on. Signed: James Givens. Delivered to Thomas Givens, July 4, 1796.
- Augusta Co., VA., Deed Book 48, p. 98, Dec. 8, 1824: James Givens and wife Jane to representatives of George Crawford, an exchange of land here-to-fore made by said George Crawford to James Givens on Middle River. Signed: James Givens, Jane Givens.
