Will of Jacob Lockhart

Will of Jacob Lockhart, Augusta County, Virginia:
I Jacob Lockhart in Beverly Manor in the County of Augusta in the Colony of Virginia, being sick and weak in body but of perfect mind and memory, thanks be to God; therefore calling to mind the mortality of my body and knowing it is appointed for all men once to die, do make and ordain this my last will and testament; that is to say, principally and first of all I give and recommend my soul into the hands of God that gave it and for my body I recommend it to the Earth to be buried in a Christian like and decent manner at the discretion of my Executors, not doubting at the general resurrection I shall receive the same again by the mighty power of God.
As touching my worldly estate wherewith it hath pleased God to bless me with in this life, I give, devise, and dispose of the same in the following manner of form:
Imprimus: It is my will and I do order that all my just debts and funeral charges be paid and satisfied.
Item: I give and bequeath to my son James Lockhart £10 current money of Virginia, to be paid by my son Jacob Lockhart five years after my decease. I likewise order that my son James Lockhart be allowed a living on the upper part of my Plantation if he should be drove from his home by the Indians, for the term of five years. And I likewise…to leave the fences in good repair at the expiration of the said term.
Item: I give and bequeath to my second son Jacob Lockhart all that part of my land lying and being on the South side of the back creek.
Item: I give and bequeath to my youngest son Levy Lockhart all the remainder part of my land lying and being on the Northwest side of the back creek but if the said Levy Lockhart should die in his non age, the said land to go and be possessed by my second son Jacob Lockhart.
Provided my son Jacob Lockhart pay or cause to be paid to my two daughters Jane Lockhart and Elizabeth (Else) Lockhart £15 Virginia currency to each of them, the time of payment to be at the discretion of my executors.
I likewise constitute and appoint my well beloved friends John Moffett and my son-in-law Mathew Arbuckle my only and sole executors of this my last will and testament. Wills and legacies executed by me in any ways before this time named will and bequests ratifying and confirming this and no other to be my last will and testament.
“In witness whereof, I have hereunto set my hand and seal this 30th day of January 1771.
Signed, Sealed, Published and pronounced and delivered by the said Jacob Lockhart as his last will and testament in the presence of us the subscribers.

This last Will & Testament of Jacob Lockhart dec'd was proved by the Oaths of John Kickpatrick & Robert Clark Two of the Witnesses & Ordered to be Recorded by John Moffitt one of the Executors therein named appeared & Refused to take upon him the Burthen of the Execution of Sd. Will.
