  • Vol. 2 - Watson vs. Caldwell--O. S. 30; N. S. 10--John Caldwell's will dated 17th November, 1785 and proved in the District Court held at Prince Edward Court House, 4th September, 1793. Leaves all estate to his son, David Caldwell. John lived with David from 1766 until he died in August, 1789, aged 94 years and 6 months. (Note: this record establishes John Caldwell's dates of birth and death and his relationship to son David).

I John Caldwell being in perfect sense and apprehensive of my death do bequeath my whole Estate, being a bond of one hundred and fifty two pounds twelve shillings and eight pence to my son David Caldwell to him and his heirs forever I also appoint him my said son David Caldwell of this my last Will sole Executor.

Notes

John Caldwell was apparently married twice. The identity of his first wife is unknown. He married 2nd, Ann Finley, daughter of William Finley, prob. bet. 1753-1760. Not sure if Ann Finley was the mother of ANY of John Caldwell's children, so they have tentatively been placed with a 1st (Unknown) spouse in the Genealogy Report below.

!25 Mar. 1796: David Caldwell stated his father, John Caldwell, lived with him from about 1766 until death (about August 1789), age 94 years 6 months; extremely infirm for years; 3 ½ years before death could not speak; father wanted Negro slave to care for him & his wife; father would not have wanted Watson to help him as he had no respect for him; Holland's bond put in hands of Patrick Henry to collect in 1789; discussed with Watson offering Henry 30 lbs. [b. 1694/95].

!There was a lengthy struggle by John Watson to collect a fee from son David, after the death of John Caldwell. John had sold property first to Henry Lepner. Lepner not able to pay, then handed it over to George Holland. To secure the property Holland gave John a bond. David was afraid he would default and got Watson to prepare a Deed of Trust secured by Negros George, Handy Bob, Jeffrey & John, to be sold to settle debt. Watson claimed David promised him half of what he collected. David contested, but depositions of John Holcombe, Sr., Augustus Watson, James Clarke, Christopher Holland all supported Watson. In court of 10 May 1802, jury ordered David to pay 76 lbs., 6 shillings, 4 pence. Court of 11 August 1804 reaffirmed the order.

The next document, dated 9 October 1747, was Robert Hamilton vs. John Caldwell for 63 lbs. On 26 March 1753 John Caldwell lately of Ballibogan, the sheriff was directed to find Caldwell; this included Robert Finley posting bond. On 20 May 1753, the sheriff was again called upon. In March 1754, a bill bound Caldwell and Hunter to pay Robert Hamilton 63+ lbs. At the May Court 1758, Caldwell was still refusing to pay. I have done extensive research on this John Finley and he was married first to ____ Thomson, daughter of Rev. John Thomson; they had at least six children. John married a second time Mary (presumably Caldwell) before 1750, and they had at least three children. John and Mary Finley moved to Prince Edward County and bought property on Vaughn?s Creek from Jacob Garrett 15 June 1765. His son, William, also bought property near Vaughn?s Creek from a John Caldwell on 19 August 1765. Another son, George, was given 200 acres on branches of Vaughn?s Creek by his father-in-law, Thomas Fulton, on 28 April 1769. Coincidentally, a John Caldwell, who had been living on Vaughn?s Creek in Prince Edward County went to live with his son, David, in 1766. David also lived on Vaughn?s Creek. This is documented in a lengthy Augusta County Chancery case, Watson vs. Caldwell, that spanned the years 1785 to 1804. On 25 March 1796 David Caldwell stated that his father lived with him from about 1766 until his death about August 1789, at the age of 94 year 6 months. The elder John Caldwell?s birth year is, therefore, estimated as 1695.

Is this elder John Caldwell the father of Mary who married John Finley?

Is anyone interested in the Caldwells of Augusta County. I am interested in any Caldwell, but especially interested in a John Caldwell who may have lived in Augusta in the mid-1700s. There is a lenghty Chancery case of Watson vs. Caldwell that says John Caldwell went to live with his son, David, on Vaughns Creek in Prince Edward County about 1766. Some researchers believe his daughter, Mary, married John Finley; and his son John, married Ann Finley, daughter of William Finley. Here are my notes on this John Caldwell.
