Not to be confused with another John Caldwell who died in 1795 in Augusta County and had a wife Jane and several children. These two John Caldwell's have sometimes been confused.


Early Land Acquisition in Augusta County, VA

Acquisition of Land from Chalkley's:

  • Page 204.--20th May, 1772. George Caldwell to John Caldwell tract whereon George now lives; William Caldwell's part of said tract, Teste: Walter Davis, William Caldwell. [Note: George Caldwell had sold in 1765 for £10 the following part of his tract in Beverley Manor to his son William Caldwell, as follows: 130 acres, part of 405 acres in Beverley Manor on a branch of Christian's Creek, which is the same location that this John Caldwell's children later sold to John Swisher in 1814. John Caldwell is surely related to George Caldwell in some way, but the exact relationship needs further research]

This Indenture made the 31st day of August in the year of our Lord one thousand eight hundred and fourteen, Between Caty Caldwell widow _______ of John Caldwell decd, Molly Lynch, who was Molly Caldwell, John Marshall & Elizabeth his wife, who was Elizabeth Caldwell, James Marchall & Caty his wife, who was Caty Caldwell, John Caldwell, George Marshall Junior & Peggy his wife, who was Peggy Caldwell, David Caldwell & Annis Caldwell, Children & Devises of the said John Caldwell decd of the County of Augusta & State of Virginia, & Samuel Caldwell of the county of Lincoln & State of Tennessee, another of the Children & devises of the said John Caldwell decd of the one part and John Swisher of the said County of Augusta & State of Virginia of the other part, Witnesseth that for and in consideration of the sum of two thousand, two hundred & thirteen pounds & eight pence of good & lawful money of Virginia them in hand paid, at or before the _____ and delivery of these presents the receipt whereof they do hereby acknowledge, have granted, bargained & sold and by their presents do grant, bargain & sell unto the said John Swisher, his heirs & assigns forever, a certain track or parcel of land situato lying and being in the aforesaid county of Augusta & State of Virginia, on the waters of Christians Creek, and bounded as follows; Beginning at two white oaks in Rob Thompsons field, corner to said Thompsons & running thence South 15 degrees East 119 poles to a red oak newly marked corner to David Caldwell in the line of the meeting house land, thence S34 W 180 poles to a red oak & dead Beach oak Corner to said David Caldwell, thence S 14 1/2 E 110 poles to a spanish oak & white oak corner to John Caldwell at David Caldwells line. Hence with John Caldwell line S 53 1/2 W W 140 poles to a black oak & two white oaks, corner of said John Caldwell & Richard Holt. Hence N 36 W 204 poles to a hickory corner to David Hendersons & George Coyner thence N 53 E 160 poles to a thorn bush in a draft newly marked corner to said Corner & the said Thompson, thence with Tompsons line N 74 W 218 poles to the beginning; it being this Tract of land the said John Caldwell decd ______ of containing by actual survey, three hundred & thirty two acres, together with all the appurtenances hereto belonging or in any _______ appurtuning To have and to hold the said Tract of land with all the appurtunances with the said John Swisher his heirs & assigns forever. etc.

Will Transcript

In the Name of God amen I John Caldwell of County of Augusta and State of Virginia being sick of body but Perfect in Judgment and Memory make my last will and Testament as followeth I bequeath to my beloved wife Catherine Caldwell the whole management of my whole Estate during her widdowhood my children to be Maintained and educated of the whole Estate and if she should chuse to Marry then she is to have two shears when the Estate is two be equally divided among the Children My beloved wife Catherine Caldwell two by my Executer and she two chuse another.
This my hand and seal John Caldwell January the 25th 1795

[Note: the estate of this John Caldwell's mother, Elizabeth was granted to Catherine Caldwell, John Caldwell's wife (and widow)].

  • Page 274.--21st June, 1786. Elizabeth (mark) Caldwell's will, aged about sixty-seven years--To 3 daughters; Margrit and Catrin Caldwell, and Elibeth Sayers. Executor, John Caldwell. Teste: Walter Davis, Francis Long, Wm. Caldwell. Proved, 20th June, 1797, by Davis and Caldwell. Executor is dead. Administration granted widow Catherine Caldwell, widow of said executor. [Note: this record establishes the parentage of this John Caldwell, as his widow Catherine is named to administer John's mother Elizabeth's estate].
