Disposition of land in Augusta County, VA
- 9 April 1800: "Eldest son & heir at law of Hugh Davis deceased", James Davis of Fayette County, Kentucky sold the '525' acre parcel to James Hathorn of Washington County, Virginia:
- This Indenture made this ninth day of April in the year of our Lord one thousand eight hundred between James Davis eldest son & heir at law of Hugh Davis deceased (late of Augusta Virginia) of the County of Fayette and Commonwealth of Kentucky of the one part and James Hathorn (a purchaser under said Hugh) of the County Washington and Commonwealth of Virginia of the other part. Witness that the said James Davis as heir and representative of the said Hugh Davis for and in consideration of the sale & contract of the said Hugh Davis decesd in his life time to the said James Hathorn for five hundred twenty five acres of land in Augusta hath granted bargained sold alien and confirmed and by these presents doth grant bargain sell alien confirm unto the said James Hathorn his heirs and assigns forever all Tract or Parcel of land lying and being in the County of August State of Virginia in Beverleys Manor being a bead granted by Will Dean to the said Hugh by Deed on the 15th day of November 1768... Will Transcript
- Last Will and Testament of Hugh Davies, Sr.
- In the name of God amend this eighth day of March one thousand seven hundred and eighty six. I Hugh Davies of Rockbridge County and Commonwealth of Virginia being of sound and disposing memory and calling to mind the mortality of my body, and that it is appointed for ll men once to die, do make and ordain this my last will and testament, that is to say, Principally and first of all I recommend my soul to God, who gave it, and my body to the dust to be decently interred, at the discretion of my executors, and for such worldly goods, as it hath pleased God to bless me with, I give and bequeath in manner following - - -
- Imprimis, I order and it is my will that all my just debts and funeral charges be paid by my executors,
- Item, I will and bequeath to my beloved wife Frances on brown mare and two beds and furniture, to here and her heirs, and a sufficient maintenance in my dwelling house to be given her by my son Hugh
- Item, I will and bequeath to my son James, six shillings
- Item, I will and bequeath to my daughter Jannet Doak six shillings
- Item, I will and bequeath to my daughter Rosanah Thompson six shillings
- Item, I will and bequeath to my daughter Mary Rowan six shillings
- Item, I will and bequeath to my daughter Nancy thirty pounds, current money to be paid at the discretion of my executors as she may need it
- Item, I order and it is my will that William Dryden make a good and sufficient deed in law, of lease and release in fee simple, to my son Hugh, his heirs and assigns for ever, for the tract of land I now live on, containing two hundred and thirty acres, agreeable to said Dryden bond to me for that purpose which bond, I also give and bequeath to my said son Hugh his heirs and assigns for ever, likewise I give and bequeath to my said son Hugh the whole remainder of my personal estate, reserving and requiring him to give to my sons John and Nathaniel each one years schooling and to my son Josiah two years schooling, and also to pay to each of my four sons Robert, John, Nathaniel and Josiah the sum of forty pounds current money as they arrive at the age of twenty one years,
- and lastly, I constitute my son Hugh Davies and William Lyle executors of this my last will and testament and revoke and disanull all othe and every former will, and wills by me heretofore made.
- In witness whereof I have hereunto set my hand and seal this eight day of March 1786

- At a Court continued and held for Rockbridge County October 4th 1786 this last will and testament of Hugh Davies Senior was presented in Court by William Lyle the surviving executor therein named and proved by the oath of John Jones and John Eakin witnesses thereto and orderd to be recorded . . . and on the motion of said executor who made oath according to law, certificate is granted him for obtaining probate thereof in due form on giving security whereupon he together with Andrew Moore, Thomas Edgar and Alexander Campbell his securities ordered into and acknowledged bond in the sum of £1000 conditional according to law.
