Last Will and Testament of Hugh Davis, Jr.

In the name of God amend this eleventh day of April one thousand seven hundred and eighty six. I Hugh Davis of Rockbridge County and Commonwealth of Virginia being of sound and disposing memory and calling to mind the mortality of my body, and that it is appointed unto all men once to die, do make and ordain this my last will and testament, that is to say, Principally and first of all I recommend my soul to God, who gave it, and my body to the dust to be decently interred, at the discretion of my executors, and for such worldly goods, as it hath pleased God to bless me with, I give and bequeath in manner following - - -

Imprimis, I order and it is my will that all my just debts and funeral charges be paid by my executors out of my personal estate,

Item, I will and bequeath to my Mother Frances Davis two cows, six sheep and all the household furniture which was left me by my Father Hugh Davises will to be her entire property.

Item, I order and it is my will that my Mother have sufficient maintenance given to her in my dwelling house by my brother Robert.

Item, I order and it is my will that my sister Nancy have a sufficient maintenance given her in my dwelling house by my brother Robert.

Item, I order and it is my will that all my Fatherís personal estate left to me by his will and not before mentioned be disposed of at the discretion of my executors for the support of my Mother and family until my brother Robert arrives at the age of twenty one years and then the remainder with the increase to be his entire property.

Item, I will and bequeath to my brother James my oldest sorrel mare to be his entire property.

Item, I will and bequeath to my brother Robert the tract of land I now live on containing two hundred and thirty acres which is left to me by my Fatherís will to him his heirs and assigns fo ever likewise I give and bequeath to my brother Robert all the remainder of my personal estate, reserving and requiring him to pay to his three brothers John, Nathaniel and Josiah the sums required of me by my Fatherís will, to be paid to them as they arrive at the age of twenty one years, and also t pay to his said three brothers John, Nathaniel and Josiah, to each of them the sum of thirteen pounds six shillings and eight pence as they arrive at the age of twenty one years.

Item, I give and bequeath to my brother John a tract of land situated on the waters of the Ohio a branch of the Salt Lick Creek adjoining the lands of Capt. Samuel Atlee on the West, James Smith to the North, Major DeHaas to the East, and Quincy Bedford to the South, surveyed for John Davis, Jr. on the 20th day of July 1773, and sold by him to me on the 20th day of January 1783 containing five hundred acres, to him my said brother John his heirs and assigns for ever.

Lastly I constitute William Lyle and my brother Robert Davis executors of this my last will and testament and do hereby ratify and confirm this to be my last will and testament.

In witness whereof I have hereunto set my hand and seal this eleventh day of April 1786

At a Court continued and held for Rockbridge County October 4th 1786 this last will and testament of Hugh Davies, Jr. was presented in Court by William Lyle and Robert Davies executors therein named and proved by the witnesses thereto and ordered to be recorded and on the motion of said executors who made oath according to law, certificate is granted them for obtaining probate thereof in due form giving security whereupon they together with William Thompson, Thomas Edgar, Andrew Moore and Alexander Campbell their securities entered int and acknowledged bond of £1000 conditional according to law.
