Executor of Hugh Donaghe, et al vs. Mary Erwin, Widow of Benjamin Erwin, et al, Deposition of Andrew Erwin, 28 Jun 1820; Andrew Ervine of lawful age being duly sworn deponth and saith, that he is well aquainted with the tract of land claimed by the Ptffs. & that he is of opinion sixty dollars a year would be about the order of the rent thereof from the 1st of May 1807 until the death of Benjamin Ervine, which went took place as he believes on the 26th Decr. 1817 and that the land was in the occupancy of the Said Benjamin Ervine during this time. This deponent also states that the said tract of land was surveyed by William Ervine in the year 1818, and by the said William Ervine & Robert Scott Hook in 1819, and the annual rent he thinks ought to be the same as before stated, and further saith not.

Administrator's Bond: Benjamin Curry & Jonathan Shipman, Administrators are firmly bound unto Joseph Baxter, Walter Davis, Giles furly & Benjamin Lewis, Gentlemen Justices of the Court of Rockingham County, now sitting, in the sum of one Thousand Dollars to the payment whereof, well and truly to be made to the said Justices and their successors, we bind ourselves, and each of us, our and each of our Heirs, Executors, and Administrators, jointly and severally firmly, by these Presents. Sealed with our seals, this 17th day of March in the Year of our Lord 1818 and in the 42nd Year of the Commonwealth. The condition of the above obligation is such, that if the above bound Benjamin Curry Administrator of all the Goods, chattles and Credits, of Benjamin Erwin deceased, to make, a true and perfect inventory of all, and singular the Goods, Chattles and Credits of the said deceased, which have or shall come to the hands, possession or knowledge of him the said Benjamin Erwin and into the hands and possession of any other person for him and the same so made do exhibit or cause to be exhibited in the County Court of Rockingham at such time as he shall be thereunto required by the said Court, and the same Goods, Chattels and Credits, do well and truly administer, according to law; and farther, to make a just and true account of all his actings and doings therein required by the said Court; and all the rest of the said Goods, Chattels and Credits, which shall be found remaining upon the account of the said administrator, the same being first examined and allowed by the Justices of the said Court for the time being, shall deliver and pay unto such persons respectively as are intitled to the same by law; and if it shall hereafter appear that any Last Will and Testament was made by the deceased, and the same be proved in Court and the Executor obtain a Certificate of Probate there, and the said... do, in such case being required, render and deliver up his letters of administration; then this obligation to be void and of no effect, of else to remain in full force and virtue.

    John Erwin, constable, was ordered August 22. 1777, to arrest Alex. Miller, formerly a Presbyterian minister, on charges of disloyalty. John Erwin was required to summon as witnesses on this matter. Benjamin Erwin, Mary Erwin (wife of Benjamin), Robert McFarland, and others. This same case had already been tried once in July 1776, at which time Robert McFarland was paid 4 pence per mile for going 50 miles as a witness. This may indicate that all the parties concerned lived at some distance from Staunton, the county seat of Augusta. In this connection, we note that one Benjamin Ervine (Erwin) settled in present Highland County, Va., formerly Augusta County. He married Mary, born about 1750, and they had Elizabeth, born 1776; Jane, John, born 1780; Robert, born 1783; Benjamin, Anne. Edward, born 1790; Mary, born 1793; William, born 1795; Frances, born 1797. married 1816 to William Ervine, nephew of Benjamin; Susan and Jackson.

Died: 1805 she daughter of Dr. Robert Curry Born: 10 Nov 1717 in Isle of Man died: 29 Dec 1803 in Augusta, VA. and Ann Curry born: 25 Sep 1727 in Ulster Ireland died: 15 May 1819 (Believed to be a cousin since same last name, but not sure). Benjamin Ervine is the son of John Ervine Born: abt 1706 in Ireland died: 15 Feb 1762 in Augusta, VA. married 1724 to Jean William born:1707 in Ireland. John's parents are Edward Ervine born: 1669 in Ulster, Ireland died: 1763 in Augusta, VA. married abt 1705 in Ireland to Frances Francis (not sure of her name) born: 1685 in Ireland. (Note that the Curry line is confusing as there are several Mary's and Molly's who are daughters of Robert's)
