Disambiguation

NOT to be confused with Richard Durrett (1712-1767) of Caroline and Spotsylvania County, Virginia, who married Sara Marshall. Some researchers have inadvertently confused them or merged them together into a single person. Since Richard does not name his wife in his will listed below, it is assumed that his wife Sarah [Hampton] likely died prior to the writing of his will in 1784. Additional research is needed.

In the name of God, Amen, I , Richard Durrett of the parish of Fredericksville in the county of Albemarle being of perfect health and sound memory but calling to mind the uncertainty of human life do make this my last will and testament and first I commit my soul into the hands of Almighty God that gave it trusting in his mercies and in the merits of my Redeemer for all my sins past and first I commit my body to the earth to be buried in a decent manner at the discretion of my executors here-after mentioned and as to my temporal estate I bequeath and dispose of it in the following manner Imprimis (?)
Item. I give to my son Richard Durrett all my wearing clothes.
Item. whereas I have made a deed of gift of my land to my son Richard and hath gived him a certain sum of money in my life time I do exclude him form claiming any other part of my estate.
Item. wereas I an William Flynn is justly indebted to Stephen K. Smith's estate thirty-two pounds in lieu of money. I leave two Negroes a boy and a girl in the hands of my executors for his tow children if they are satisfied with them the boy by the name of Will I let my grandson Austin Smith have and a Negro girl by the name of Jude I let my granddaughter Mary Smith have if the have not satisfied with the two said Negroes my executors shall sell the said Negroes and pay the debt and divide the balance between the two grandchildren. I also give my grandson Austin Smith one mare and saddle one cow and calf one ewe and lamb one small trundle bed and furniture and five pounds to school him and the work of his Negro to maintain him which I desire may be left in the hands of my son-in-law Robert Sanford till he comes to the age of eighteen and if my two said grand children Austin Smith and Mary Smith should but die before the come of age or have an heir lawfully begotten of their body that what I have given shall return to my estate and be divided between my five daughters, Elizabeth Watts, Ann Sanford, Francis Wills, Agatha Flynt, Mildred Williams.
Item: I give to my grandson Austin Wills my prayer book. If my grandson Elijah Watts doth pay into my estate twenty shillings for every year he has had my Black Smith's tools he may have them if not they shall return into my estate.
Item. Whereas I have given my two granddaughters Sarah Flynt and Susanna Burras one Negro woman and increase I do exclude them from claiming any other part of my estate.
Item. whereas I have given my Daughter Sarah Flynt deceased one tract of land I exclude her son Richard from claiming any other part of my estate.
Item. I gave to my daughter Ann Stanford my riding gear (or cheer) and harness and my sorrel horse and looking glass and ten pounds to be raised out of my estate.
Item. I gave my daughter Agatha Flint two Negroes named Samson and Humphrey an my serman book ste forth by William Edwards (??????) to dispose of as she thinks fit.
Item. I give to my granddaughter Nansee Stanford five pounds.
Item. I give my grandson Rubin Sanford all my corn and fadder and provisions of every kind I have on the plantation when I die I give it to my grandson Rubin Sanford and he shall keep the Negroes and tools to finish the crop he my said grandson cloathing (sic) my Negroes and paying their taxes if I should die shortly what crop my taxes and cloating (sic) my Negroes and paying my debts.
Item. it is my desire that my whole estate stock household furniture and tools and all that I have not yet given away may be equally divided amongst my five daughters namely Elizabeth Watts, Ann Sanford, Frances Wills, Agatha Flynt, & Mildred Williams and I do here by constitute and appoint my son Richard Durrett and my son-in-law Robert Sanford joint Executors of this my last will and testament utterly revoking all other previously and heretofore made declaring this and no other be my last will and testament. In witnensseth whereof I have hereunto set my hand and seal this eighteenth day of Oct 1784.

    A genealogical chart of the Terrells n the possession of Gen. W.H.H. Terrell, of Indianapolis, states that Abigail, daughter of Henry Terrell and Ann Chiles, of Caroline, was married to Colonel Durrett of Albemarle. If this refers to Colonel Richard, she must have been a first wife. According to the records, the name of Richard's wife was Sarah. He passed his days on Priddy's Creek, and died in 1784. His children were: Richard, Elizabeth, the wife of Jacob Watts; Ann, the wife of Robert Sanford; Frances, the wife of Frederick William Wills; Agatha, the wife of William Flint; Mildred, the wife of a Williams, the wife of Stephen K. Smith, and the wife of a Burrus.

    - Note: the author apparently has confused two different Richard Durrett's, one in Albemarle County and the other in Spotsylvania, as noted in the advisory on this page.
