Will of James Kerr
- I James Kerr now being of perfect mind and memory and calling to mind that it is appointed for all men once to die, Do in the Presence of god and before these Subscribing Witnesses, do publish and declare this to be my last Will and Testament in manner and form following; that is to say first I give up my soul to God who gave it.
- Secondly my body to be buried in a decent and like manner; also all my just Debts to be actuarially paid and afterwards all my worldly Property to be distributed and given in manner and form forloing.
- First I give to and Bequeath unto my Dear and loving Wife her living on my land during her natural life, Secondly I give to my Said wife one black mare Saddle and bridle, likewise two milk cows, and four head of sheep and half my Stock of hogs; also give and bequeath to my Said wife one good feather bed, a bed stead with good furniture, likewise one cherry table, one cupboard with the furniture also all the kitchen furniture containing castings and cooking vessels, likewise all my Chests and trunks, and one cotton wheel and cards, one flax wheel and one reel, also one weaving loom with all the slays and harnesses, likewise all the feathered foul of every kind, all which I give and bequeath to my Said wife for her support and comfort until her last expiring breath, then if there should be any of the said fore mentioned property, at or after her Decease I would wish it to be divided amongst my five oldest Sons, as may be thought best.
- Next I do give and Bequeath to my son James Kerr one of last spring's Sorrel horse colt, and one milk cow, Next I do give and bequeath unto my Son David Kerr all that tract or parcel of Land whereon I now live to be his right and title claim and property always, I do also give to my said son David my bay prock mare also my plow and horse gears, one ax, one mattock, and one weeding hoe, also half of my Stock of hogs by giving James and Samuel each of them one breeding Sow if the Stock will admit of it, also all my Shop and Shoemakers tools, to be his right and title, Next I do give and Bequeath to my Daughter Mary Odil three dollars.
- Next I do also give and Bequeath to my Daughter Nancy McGowin three Dollars, all my other property not mentioned here, to wit all my young Cattle I give and bequeath to my five eldest Sons, viz William, John, Andrew, James, and Samuel, and lastly in order to put this my last will and testament into Execution I Nominate my three Sons to wit William, John, and, Andrew as my Executers to act for me in my Stead to give and deliver as I have here set forth, as I my Self might or could do was I to be personally present, in witness whereof I have hereunto Set my hand and fixed my Seal this tenth day of November 1817.

James Kerr, Jr., was born in Pennsylvania July 3, 1743 and came with his father's family to Orange County, North Carolina and settled at the head of the Eno River. In 1780, he married Nancy Mitchell, daughter of Andrew and Mary(McGowen) Mitchell of Orange County. To them were born six sons and two daughters. All of his children were born in North Carolina, subsequently went to Tennessee and raised large families of their own. His oldest son William and his second son John,went to Tennessee in Dec. 1805.
James Jr. daughter Mary "Polly" Kerr married John Odil before going to Tenn.
I have all info on this KERR family. Will share any info that I have.

P. 12 James Kerr came to Williamson County, Tennessee from Rowan County
North Carolina, Salisbury District (where he lived) August 15, 1808. He owned land in Tennessee on Rock Creek, on Duck River, 200 acres in 1808 and gave power of attorney to William McEwen of Williamson Ca 12-28-1808, to attend to the property while he was yet in North Carolina.
James Kerr and Nancy Mitchell were married in North Carolina, date unknown.
He died in Maury Co., Tenn. leaving his will, dated 11-10-1817. In it he leaves his wife "her living, for her natural life"; also stock and household goods. His son, James, Jr. "all the land where I live". Son David "farming tools, stock and Negroes". Daughters Mary Odil, Nancy McGervin (or McGowan) (some sources list her as Nancy Ferrin). Eldest sons William, John, Andrew, James and Samuel; his Executors, my three sons, William, John and Andrew. 10 November, 1817. Signed James Kerr.

Book C., Vol. 1, p.211 Columbia, Tenn..The family of James Kerr and Nancy Mitchell are found in Maury County a few miles from Spring Hill, on Rutherford Creek.

Notes for NANCY MITCHELL:
Nancy parents,were of Scotch Irish descent. Her father Andrew Mitchell her mother, Mary Mc Gowin, were married in Ireland and emigrated from County Limerick, and settled in the Scotch Irish Colony in Western Pennsylvania about 1750.
Andrew's brother, David and his sister Isabella, who had married a Stewart, came with him and settled in the same colony. In 1752 Andrew and his wife Mary, his brother David and his children came to Orange County, North Carolina and settled on New Hope Creek. The first court in the County (Orange County being formed in 1753), met at the home of John Gray on Eno River.
Andrew Mitchell was one of the first Justices in the first court of Orange County. He was a member of the Parrish of St. Matthew established in 1752, and was a vestryman. This parish was located at Hillsboro, North Carolina and was a branch of the established church of England. He was known as "Squire Mitchell of New Hope Creek."

Notes for JAMES KERR:
Came to Tennessee with his father's family in 1808 and purchased land on Fountain Creek. "James Kerr, Gentleman, produced in Court a license to practice law in the several courts in Tennessee and was qualified, 5-16-1826."In 1835 he was a Trustee of Pleasant Grove Academy. On the 28th day of April, 1840, he bought land in Lawrence County and moved there.
