Confusion Regarding William Stewart/Stuart

Caution: some sources claim that this William Stewart/Stuart married Margaret Usher, daughter of Edward Usher. That is incorrect! The William Stuart that married Margaret Usher was a different (and younger) William Stuart that left his will in 1796 in Bath County, VA and named entirely different children.

Will of William Stewart

From Chalkley's:

  • Page 170.--12th January, 1768. William Stewart's will, freeholder--To sister Jane, lands and chattels left to me by my father in the town land of Raffrey, was married to Wm. Marshall; to Ann Stewart, married to Thomas Osborn; to Mary Stewart, married to Andw. Shaw; to Elizabeth Stewart, married to John Patton; to Francis Stewart; to William Stewart, infant, when at age my land on Middle River, formerly owned by James Henderson; to brother John Stewart, executor. Teste: Thomas Stewart, Thomas Thompson, John Petter, Robert Hamilton. Proved, 18th November, 1768, by Thos. Stewart, John Peters. John Stewart qualifies executor, with Thos. Stuart and John Bowyer.

(Note: sources indicate that the William Stewart, infant listed in this will was the son of William's brother John, not his own son.)

Records of William Stewart in Augusta County, VA records

From Chalkley's:

  • Vol. 1 - NOVEMBER 21, 1768 - (31) Wm. Stewart vs. James Anderson.--Abates by plaintiff's death.
  • Vol. 1 - OCTOBER, 1769 (A). William Stewart's Executor vs. Wm. Christeele and John Archer.--John Stewart, executor of William. 29th June, 1769.
  • Page 183.--20th September, 1785. John Stuart and Frances, heir-at-law of William Stuart, deceased, to Archibald Dixon. (Note: it appears that this MAY refer to this William Stewart/Stuart, more research necessary to determine the relationship to John and Frances Stuart (possibly a son not named in will?)).
