Will of William Holliday of the Burrough of Winchester in the County of Frederick and Commonwealth of Virginia
"First, I give and bequeath unto my beloved wife Jane one third part of my hole estate real and personal together with the use and priviledge of the house whereon I now dwell and all and singular the house hold Furniture (as now pccupied by me) during her natural life".
"Secondly I give devise and bequeath to my son Robert and his heirs the plantation which I purchased from Robert Denny and was conveyed to me by Robert Samuel Denny and wifes, Situate lying and being in the County of Frederick aforesaid Containing two hundred and fifteen acres with the buildings thereon Standing, also one thousand acres of back lands Situate lying and being about Six miles distant from the Kentucky River and Oposite to Kentucky being so much of a Survey of fifteen or sixteen hundred acres of Soldiers rights surveyed on my acco0unt by John Macher and two hundred acres of Land on Cumberland River in the County of being part of a Survey of one Thousand acres made by General Mulenberg and William Richman also Fortynine acres of land situate lying and being on the drains of Opeckon in the County of Frederick aforesaid and adjoining the Lands of Daniel Candy and Samuel Glass purchased from Robert Rutherford, Conveyed to me by deed from said Robert Rutherford and Wife and half a Lot with the Buildings thereon Situate lying and being in the town of Bath in the County of Berkeley and State of Virginia aforesaid purchased from Joseph Holmes and also one hundred and ninty two and a quarter acres of Land Situate lying and being in the County of Frederick aforesaid adjoining the Lands of Thomas Bryan Martin being one half of a survey of three hundred and Eighty four and half acres purchased from Aarchibald Magill also my Mouse Clock which he is to have on the Death of my aforesaid Wife and not before."
"Thirdly I give and bequeath to my son William and his heirs Lot No. 52, Situate lying and being on the West side of Louden Street in the said Town of Winchester with the Dwelling House and othe[r] buildings thereon Standing and containing Eighty one feet in Front on Louden Street aforesaid and extending back to Joseph Luptons Lot in the said Town, and Lot No. 40 in the commons of said Town annexed to said Lot No. 52 purchased from Robert Rutherford and conveyed by deed from said Rutherford and Wife, and my Gold Watch which I now ware."
"Forthly I give and bequeath to my Daughter Jane and her heirs a Tract of Land Situate lying and being in the aforesaid County of Frederick Containing one hundred seven and one half acres purchased from Samuel Denny and conveyed to me by Deed from Robert and Samuel Denny and wifes aforesaid adjoining the lands purchased from Robert Denny and herein before devised to my Son Robert.. And also a Tract of land in the aforesaid County of Frederick adjoining the land of Thomas Bryan Martin Containing one hundred and ninty two and one quarter acres being one half of a survey of three hundred and eighty four and a half acres purchased from Archibald Magill the other half of which is herein before devised to my son Robert and Lot No. 50 Situate lying and being on the West Side of Cameron Street in the said Town of Winchester containing 119 feet in front of Cameron Street and extending 150 feet fronting Piccadilly Street and Lot No. 54 in the common of said Town annexed to said lot No. 50 purchased from Robert Rutherford and conveyed to me my deed from said Robert Rutherford and wife and Two? hundred Pounds in Money."
"Fifthly I give devise and bequeath to my son James and his heirs the lowre? on South half of Lot No. 6 Situate lying and being on the West Side of Loudon Street in the Town of Winchester afore said with the Buildings thereon and half of Lot No. 53 in the Commons of said Town and annexed to said Lot No. 6? purchased from Robert Gregg and conveyed to my by deed from James Craick and wife, also the South end or half of the House. Therein I now live containing about Twenty one feet in fronnt the under part of What I now occupy for my Store and Twenty feet of Ground Extending Wist from the North Side of the back door of the said aforesaid memised Primisies thence South to his aforesaid half lot which space of twenty feet is intended for a passage to his garden and one half of Lot No. 6? laid off in addition to the said Town of Winchester Situate lying and being on the east side of Braddock Street purchased also from Robert Gregg and conveyed to me by deed from James Craichs and wife like wise Two hundred Pounds in money."
Sixthly I give devise and bequeath to my son Elijah and his heirs a Tract of land Situate lying and being on the North Side of the Town of Winchester in the County of Frederick aforesaid adjoining the Lands of John and Edward Smith and nearly adjoining the out lots of said Town Containing in all one hundred and forty eight acres formerly laid of in ten acer [acre] lots and purchased from Messrs. Robert Rutherford, Barbara Loubinger, Thomas Smith, Henry Baker, Lewis Hoff and Edward Smith also five Hundred acres of Back land Situate lying and being about Six Miles over the Kentucky river opposite to Kentucky being the remainder of a survey of fifteen or sixteen hundred acres I had by John Machir as herein before mentioned and bequeathed and Lott No. 2 Situate lying and being on the East Side of Braddock Street aforesaid purchased from Robert Gregg and conveyed to me by from the said Robert Gregg and wife."
"Sevently I give devise and bequeath to my son Alexander and his heirs the North end or half of the house wherein I now dwell Containing about twenty nine feet in front of With one half of the Lot No. 6? Situate on the west side of Loudon Street in the Town of Winchester aforeseid and one half of Lot no. 53 in the Commons of said Town and annexed to lot No. 6? aforesaid purchased from Robert Gregg and conveyed to me by deed from James Craigh and wife) excepting and reserving the privileges of twenty feet of ground herein before devised to my son James for a passage to and from his garden) also one half of Lot No. 6? Situate lying and being in Braddock Street as herein before described purchased also from Robert Gregg and conveyed to me as before, also Twenty eight feet of ground off the south side of Lot No. 52 in the Town of Winchester on the West Side of Loudon Street as before discribed and two hundred Pounds in Money."
"And my Will and desire is that my wife shall have hold and ejnoy the House I now dwell together with the use and privilege of all and singular the Household furniture (as herein before devised) during her natural live and at her decease the said Household furneture Shall be devided equally amongst my Children Share and Share alike (except my Clock herein before devised to my son Robert Which he is to have exclusive of his full Share of the aforesaid Household furniture) that my Wife Shall also have the Benefits of all and singular the Rents Isues? and profits of all the Lands messanages? Houses and tenements and also the Interest of all Legacies herein before given devised and bequeath by me for and towards the Support Maintenance education and bringing up of my aforesaid Children untill they severally and respectively arive at their full age of twenty one years or day of Marriage* then my will and desire is that what ever is herein given devised and bequeathed to him her or them Shall go and be equaLLY divided amongst my surviving Children Share and Share alike payable and as aforesaid and my will also is that my Wife shall have the use and employment of Negrose George for and during the Space of five years from the first day of January last past at which period he shall be free - and that she Sjhall also have my two Negroe wenches, Namely Moree and Sall with their future Seed and Issue during the aforesaid Terms of her natural life and at her decease, or any athe time shall have a power of disposing of them as she thinks proper and that she shall also have three Cows, Three Horses and as many of the farming utensils as may (by my Executors) be thought necessary for her to keep and the remainder of my Stock of Horses, cows and Sheep, and farming utensils to be sold and the money arising from said Sales Shall go towards the payment of my just debts or be disposed of as may be thought most expedient."

"I also desire that the new meadow (a part of the land bequeathed to My daughter Jane may not be later other wife disposed off but kept for the use and Convenience of my wife and Children until she/my said daughter) arrived at the age to be put in possession of the same it is also my will and desire that my Murcantile Business be continued and carried on for the Space of two years after my decease under the government and direction of Adam Douglass and I do impower and authorise him during that period to may all my just debts and collect all debts due to me either by Bond note, Book account of otherwise and for his survices during the aforesaid term of two years he shall receive one third part of the gains or profits that may be garned during said term and at the expiration of the said Term of two years Whatever goods or merchandise may be then remaining on Hand Shall be sold and after payment of all just debts and Legacies the rest residue and remainder of al my singluar my worldly estate both real and personal to be equally divided amongst my Children, also it is my Will and desire that the aforesaid Adam Douglass during the said term and space of two years shall (exclusive of the afore said profits) be found in boarding washing lodging and as many Clerks or assistants as he may find necessary together with Storeroom, Warehouses and every other convenience for carrying and said business".
"My Three Mullatos (Namely) Dan. Mary and Emma, I give as follows (Viz): Dan. to my son Robert, Mary to my son William and Emma to my daughter Jane and my Will and desire is that each and every of the aforesaid Mullatos Shall be free as soon as they Severally and respectfully arrive at the age of thirty one years."
"And lastly the better to secure to my said Wife Jane the full third share of all my real and personal Estate during her natural life. I do here again for the Better explanation of my Will and desire repeat that the first bequest made in this my last Will and testament is my true and real Intentions also with respect to my Slaves, Horses, Cows and farming utensils and I hereby nominate Constitute and appoint my wife Jane , Ignatius Peary, James Walker and Isaac Sittler Executors of this my last will and testament, hereby revoking all former wills by me made."

At a Court continued and held for the District composed of the counties of Frederick, Berkrlry, Hampshire, Hardy and Sanando at Winchester the Sixthteenth day of September 1790.
This last will and testament of William Holliday decd. was proved by the oaths of Hugh Scott, Robert Macky and Robert Wells, Witnesses thereto and ordered to be recorded and on the motion of Jane Holliday the Executrix therein named who made oath according to law Certificate is granted her for obtaining a probate thereof in due form giving Security whereupon She with James G. Dowdall and James Holliday her Security entered into and acknowleged Bond in the penalty of ten thousand Pounds conditioned for the due and faith full administration of the said Decendaents estate.

  • Page 69.--17th April, 1788. James Culbertson's will--(Sets out transactions with Maj. Robt. Burns and Isabella Burns in 1782 and since showing indebtedness to him); also that out of his 4,000 acres to which he is entitled as Captain in the Virginia Line, he has sold 1,000 acres to Hugh Donaho, lying near Mouth of Miami; also Thomas Johnston, of Louisa, is to have 800 acres; Richard Bruce, of Albemarle, owes him £4 balance for a watch, &c., after deducting £3.0.0 allowed him to pay his brother, George Bruce. His accounts for services as Commissary and Quarter Master and Forage Master to Polaski's Legion (vouchers in hands of Capt. Geo. Rice (Brice) have not been paid. Also for services as issuing Commissary for the Prisoners stationed at Staunton of Burgoyne's Army (also in hands of Capt. Geo. Brice) also unsettled. Capt. Wm. Long owes £60 for money lent and other transactions in 1776. Robert Draffors (ons), of Charlottesville; Geo. Divers, of Albemarle: Wm. Holliday, of Winchester; Col. Thomas Rell and Mrs. Brice's claim for washing which she has charged to Robert Gamble to be paid. Then all debts to be paid (after deducting his reasonable wages as storekeeper for Gamble; John North). John Parris to be allowed 500 acres military lands for making clothes. Estate to be divided between brothers and sisters, viz: Robert Culbertson, Molly, Anne, and Margaret. Executors, brother Robert Culbertson, of Sherman's Valley, Penna.; Thomas Bell, Anthony Mustoe, Robert Gamble. Teste: Alex. St. Clair, Hugh McDowell, John Boys. Proved, 17th June, 1788. Anthony Mustoe qualifies.

Hi Beverly.. Could the Robert Holliday that you are looking for me, Robert B. Holliday, born: 14 Nov 1776 and died: 31 Jul 1802.. If so, he would be the son of William Holliday, who settled in Winchester, Frederick County, Virginia in 1768. William Holliday married Jane McClanahan, daughter of Elijah McClanhan from Augusta County, Virginia. Jane was born about 1743. Her husband William Holliday died in Winchester in 1790. There children were:

(1) Robert B. Holliday, born: 14 Nov 1776 and died 1802,
(2) William McClanahan Holliday (also called Long Billy) was born on 2 July 1780 in Winchester, married 11 Feb 1806 to Helena Billmyer at York, Penn. Had a son Daniel that moved to Baltimore, Md, William died about 1853 in Winchester??
(3) Jane B. Holliday, born 22 June 1782 in Winchester, married 27 Apr 1809 and married in Winchester to Fleet Smith of Leesburg, Virginia
(4) James W. Holliday born Apr 1784 in Winchester,
(5) Elijah Holliday, born 26 |Dec 1785 in Winchester, and died 1869 in Winchester,
(6) Alexander Holliday born 15 Apr 1787 married Elizabeth Bent, daughter of Lemuel Bent ,
(7) Nancy Holliday born 8 Dec 1788 in Winchester and died 11 May 1790........

After William Holliday died, Jane McClanahan Holliday, remairred to Reverend Joseph Cadwell on 18 December 1792, at Winchester.... This Holliday is believed to be a cousin of my Holliday,s who also lived in Winchester, Virginia at the same time... My line is William Holliday and Sarah Thompson (fhe came from Scotland and moved to Belfast, Ireland and was a Silvershmith) They moved to america with three sons William, Richard, and James Holliday as was soon followed by another daughter Sarah Holliday that married William Gillis (my g-g-g- grandfather).. The elder Hollidays stayed in the Philadelphia area and the boys and William Gillis soon moved on the Winchester, Virignia.. The grandson of the William Jr, became the Gov of Virginia 1878-1882. That they were there by 1790/91.. I also know of another Holliday Family in Louisa County, Va.. ...Anybody out there that thinks that they can help me on the Hollidays..Please contact me..I have about 18 years research invested in working on the Hollidays of Winchester.. The county that you mentioned, is the next county over from Frederick County.. Thank you... Lee Gillis
