James McKay (McAkay) and Mary, of Frederick, to Thomas Bryan, £80, 300 acres on Linvell's Creek, part of 1200 acres patented to McKay, Green and Hite, 26th March, 1739, and by them conveyed to Robert McKay, 19th June, 1746, and by Robert devised to James by will in Augusta; John Bryan's line. In the name of God Amen ~~ I Thomas Bryan of the County of Rockingham & State of Virginia yeoman being of the age of Seventy two years and sencible feeling the decay of Nature although of perfect mind and memory calling to mind the mortal lity of the Body and that it is appointed for all men once to die Do make and ordain this my last will and testament in the manner & form as follows Viz.

First of all & imprimis I give & recommend my soul into the hands of Almighty God who gave it and my body to the Earth to be buried in decent & Christian like manner at the dischresion of my of my under named Execrs not doubting but that I shall receive the same agin at the General resurrection of the just. And Secondly all Just and lawful debts and funeral charges to be paid and as tuching my worldly Estate wherewith it hath pleased God to bless me with in this life I give and bequeath in the following Manner viz:

Item I give and bequeath unto my well beloved grand Daughter Hannah McDonnald thirty Acres of pine Land adjoining John Reevses place

Item I give and bequeath unto my well beloved Son Thos Bryan one hundred and fifty Acres of Land whereon he now Dwells reserving two Acres whereon the Meeting house and grave yard Stands_

Item. I give and bequeath unto my well beloved Son Peter Bryan the one half of a bond upon Gasper Moyers now in my possession_

Item I give and bequeath unto my well beloved Sons viz_ Thos Wm and Allen Bryan three hundred and twenty acres of Pine land to be divided equally among them_

Item I give and bequeath unto my well beloved Son Wm Bryan a little place upon the North west end of Gasper Moyers place Said Gasper Moyers having made to him one hundred and fifty acres of the place he now lives on in the first place and the remainder to be disposed of as above and likewise a little place_ known by the name of bald hill containing fifty acres_

Item. I give and bequeath unto my well beloved Son Wm Bryan a Set of Black Smith tools now on the plantation I now live on_

Item I give and bequeath unto my well beloved Son Allen Bryan the plantationI now live on lying between the place I bequeathed to my Son Thos Bryan and my Soninlaw Wm Bryans plantation._

Item I likewise give and bequeath unto my Son Allen Bryan a Negro Man named Harry untill the age of forty years and then Said Negro to have his freedom _

This last will and Testament of Thomas Bryan Decd was presented in court by Thomas & Wm Bryant Executors therein named and proved by the oaths of the Subscribing Witnesses thereto and is ordered to be recorded and on the motion of the Said Executors who with Security entered into Bond conditioned as the Law Directs and made oath thereto a Certificate is Granted them for obtaining probate thereof in due form ~

• Vol. 2 - Alexander Campbell and Jane his wife, of Rockingham County, vs. Herring--O. S. 176; N. S. 62--Bill 29th May, 1804. Jane is one of sisters of the full blood of William Herring, late of Rockingham,b who died intestate. At time of his death complainants lived in Ireland, where the other sisters now reside, but shortly afterwards removed to Rockingham. Thomas Herring of Rockingham, claiming as half-brother of William, administered. Answer questions Jane's relationship to William. Thomas Heron left Ireland about forty years ago. There was a coroner's inquest on William's body. He was drowned. Agreement dated 16th August, 1792, between the subscribers and William Herron, schoolmaster. William is to teach an English school at following rates, viz: for £30 he is to teach for one year and to have his boarding, washing, and lodging. He is to teach the scholars well and truly in Reading, Writing and also Arethmetick, with care and attention. 3d October the school is to commence. Jacob Lincoln, Solm. (?) William Blain deposes that William Herron was drowned in attempting to cross North River, Thomas Herring deposes, 1808, that from 1784 William until his death lived with him. Hugh Paul deposes that he was well acquainted with William Herron and Alexander Campbell's wife, and knows that they were full brother and sister. John Glendye deposes, 21st January, 1805, that he was acquainted with a certain William Herron in Ireland for some time before his death, being very aged when deponent first knew him. Deponent was the stated Minister of the Gospel in the Congregation of which said William was a member for about 20 years before deponent came to America. Said William was twice married and had children by the first marriage, particularly a son Thomas. Deponent never saw Thomas in Ireland, he having left there before deponent came to that congregation and had come to America, but since he came to America deponent has seen a Thomas Herron of Rockingham who he understands is the same Thomas. Deponent says he knew William Herron, Charity Herron, who married Thomas Kyle, since deceased, Jane Herron, who married Alexander Campbell (plaintiff), and Mary

Herron, who married Thomas Mitchell, all children of William Herron by the second marriage. That William, Jr., frequently officiated as singing clerk to this deponent in his congregation in Ireland for several years. William, Jr., came to America some years before this deponent, but when deponent settled in Staunton, some time before William, Jr., died, the latter was an inhabitant and he officiated again as clerk for him in Staunton. Deponent knew Alexr. Campbell and his wife, Jane, in Ireland and since they came to America, and he celebrated their marriage. Taken at house of Nathan Griffith in Baltimore, 21st January, 1805.
