Will Transcript

Samuel Henderson's Will
In the name of God, Amen 9th day of July the last Will and Testament of Samuel Henderson who is in perfit health and memory first I recommend my soul to God who give it and my bode to be Decently buried not Douting but at the Resirection I shall Receive the same by the Almighty power or God that give it and as to my worldly Estate I order it to be divided in the following maner (Viz)
first it is my Will that all my Just Debts and funerl Charges to be paid and I order to my son John the sume and cost that Hays recovered by Law and one Dollar.
I order to my son Samuel one hundeer pounds.
I order to my son James's son Samuel fifty pounds.
I order to my son William fifty pounds
i order to my Doughter Jean ten pounds and to my Doughter Margrit ten pounds
I order to my Doughter Nancy one Negro named Charety and one horse or mare at her own choosing one bed and Clouths and three Cows and my Desk and the furniture of the Dresser
I order to Nancy's son twenty pounds and to her Doughter one bed and Cloths and I order the Rest of my moveable Estate to be Equily devided betwixt my three Doughters to wit Nancy, Sarah and Martha and as for my Land I order it to be devided to my foresaid Daughters.
Nancy to have the Bildings and orchard in her part and if my three Doughters agrees to Sale my Land I order what they sale it for to be equely Devided between them and them to make a Deed to the byer.
I do make and ordain my son William and Tobias Miller to be my whole and Sole Executors of this my last Will and Testament.
I hereby disalow revock and every other Will forms Testaments, Wills legasies Ratifing confirming this and no [o]ther to be my last Will and Testament in witness I have hereunto set my hand and seal this 8th day of July 1806.

At a Court held for Franklin County April 3d. 1808
This Last Will and Testament of Samuel Henderson deceased was proved by the oath of John Webster, Edmund Torrey, and Thomas Billups, the Witnesses hereto, and ordered to be recorded, and on the motion of William Henderson and Tobias Miller the Executors herein named, who made oath as the Law directs, & together with Peter Saunders Jr. and James McVey Jr., their securities entered into, and acknowledged their Bond in the penalty of five Thousand Dollars, conditioned according to Law Certificate is granted them for obtaining a Probat in due form.

    At the Breckinridge County Courthouse I found proof that Joseph Mason's wife was Jane Henderson. Jane's father Samuel Henderson died and left land in Franklin County, Virginia. In Deed Book A. page 493, is a legal document transferring Power of Attorney recorded 15 October 1809 whereby "Joseph Mason and Jane, his wife, late Jane Henderson, of Breckinridge County, Ky." appointed "Samuel Mason their lawful attorney, to ask and receive what they are entitled to from the estate of Samuel Henderson, deceased, who died Franklin County, Va."
