Early Land Acquisition in Virginia
Acquisition of Land in Virginia:
- 24 May 1765, John Sevier and Sarah his wife sold to his sister, Mary (Polly) and her husband Robert Rutherford, for 50 pounds, 100 acres of the 378 acres he had recently purchased from his father. These 100 acres was located along the Shenandoah –Rockingham County Line. [Frederick Co. DEED BOOK 11, page 454].
Disposition of Land in Virginia:
- 19 Nov. 1776, Robert Rutherford and Mary his wife, of the County of Dunmore (later called Shenandoah) sold their 100 acres joining the county line to William McDowell. [Shenandoah Co DEED BOOK B page 410].

I Robert Rutherford of the [County of] Rockingham and State of Virginia being weak in b[ody and] mind and memory calling to mind the mortal[ity] _____ & knowing that it is apointed for all men once to [die do make] thsi my last will and testament in manner fol[lowing].... [rec]ommend my soul to the hands of God who gave ___ ______ [my] body to the earth to be buried in a Christia[n like] manner at the direction of my executors, an________ worldly estate wherewith it hath pleased god [to bless me with in this] life, I direct and dispose of the same in the ______ _____.
- I give and bequeath to my wife Marth[a] __________ _________ all house on the south west corner of ___________ __nd one fourth part of the said lott to _________ine parealel with the alley between my _____________ ____ hold the same during her nat[ural life] ________________>
- Order from County Court minute Book March 19, 1811.
- The last will & Testament of Robert Rutherford dec'd was presented in court and proven by the oath of George Huston, Daniel Smith and John Hall witnesses thereto and ordered to be recorded and on the motion of Archibald Rutherford the Executor named in said will who made oath and entered into and ask'd bond with security according to law a certificate is granted him for obtaining a probate thereof in due form and it is ordered that George Sites, Joseph Thornton, Henry Tutwiler & Jacob Rohr or any three of them being sworn do appraise said estate and make report & c.

- Robert was styled "Captain" throughout his later life.
- In his will, he named Archibald, Elliot, Mary, Ann, and Robert as his children with Mary SEVIER.
