Early Land Acquisition in Augusta County, VA

Acquisition of Land:

Johnson County, North Carolina: We do not know the relationship, if any, between Matthew Patton and Col. James Patton, who was killed by Indians in July 1755 at Draper's Meadow massacre. Col. James Patton did not mention a son Matthew in his will in 1750. Matthew Patton acquired land in Johnson County, NC, where a survey for him was dated Sept. 22, 1762. George Barber's and Samuel Orr's names were on the plat as chain bearers for the survey, and Charles Young signed his own name to the plat as surveyor. "Surveyed for Matthew Paten (sic) a Tract of Land Containing Six hundred acres lying in Johnson County on the Great Branch Joining Smith's line including his own Improvement Beginning at a pine Running south 240 poles to a white oak, Thence East 400 poles to a white oak, thence North 240 poles to a white oak, thence a right line to the beginning." 1761 Reuben Hunter purchased 347 acres in Johnston County, North Carolina from Robert Orr and moved to Johnston County. Deed Witnessed by Theophilus and Isaac Hunter (Tavern Isaac). [1]
1762 Dempsey Hunter of Johnston County, North Carolina was required to help lay out a road from Dry Pond where it ends to the county line at Herring Springs. John Simmons, James Lynn, Rubin Hunter, William Utley, Edward Green, Joseph Hincock, Arthur Cook, John Smith, William Spreight, Jonathan Monk, Robert Orr, William Blake Jr., John Arkins, Samuel Parson. Dempsey was 42. Dempsey was witness to the deed of John Simmons, Johnston County, North Carolina for land on Walnut Creek. [2]
Johnson County, North Carolina: In Johnson County, North Carolina, Matthew Patton's name occurs at least eight times in the minutes of the Inferior Court of Pleas and Quarter Sessions. Initially, on the third Tuesday in July 1761 in Johnson County, NC, Matthew Patton was one of sixteen men who were "ordered for a Jury to lay out said road" leading from the house of John Gyles Thomas to the Johnson court house. (Haun, Min. Bk I, pp. 68-36). Next, on Oct. 17, 1764, "in the fourth year of the Reign of our Sovereign Lord George the Third," Mathu Patten (sic) was listed as one of the twelve Petit Jurors (Min Bk I, p. 196-101). Then on Jan. 22, 1766, Matthew Patton again served on the petit jury (Min Bk I, p. 238-122). Fourth, on Jan. 22, 1766, Matthew Patton was one of twelve jurors appointed to lay out a road "leading from the long leafed pine to Isaac Hills plantation" (Min Bk I, p. 230-118). The next year on Jan. 22, 1767, the court "ordered that Matheu Patens (sic) mark be recorded which is half moon under each ear" (Min Bk I, p. 258-132). The sixth time his name occurred was when the court ordered that Mathew Patton be appointed constable in the room of Robert Orr (Min Bk II, p. 44-151). Three months later, May 24, 1768, the court "ordered that Mathew Patton be appointed overseer of a road in the room of Robert Orr" (Min Bk II, p. 53-156). Finally, on Aug. 11, 1770, Mathew Patton and eleven others "being a Jury Impaneled & Sworn Give there Verdict that the Defendant was not committed to Goal" (Min Bk II, p. 123-89). Rootsweb.com
Matthew Patton witnessed at least one deed and one will for neighbors. On March 6, 1780, Joshua Sugg and Matthew Patton, witnesses to the will of Robert Orr deceased, came into court and proved the will by their oaths (Wake Co. Minute Bk I, 1777-1784, p. 135). Then, on May 12, 1780, when Thomas Busbey executed a deed to Samuel Holliway for 200 fires on White Oak Creek, the witnesses were Matthew Patton and Solomon Patton (Joseph W. Will of Robert Orr, Wake Co., NC, 1780.
Imprimis I give and bequeath to Elizabeth my Dearly beloved wife the possession of my Lands Messuauges and tenements togetehr with my house hold goods and moveables by her freely to be possessed and enjoyed for her use and pleasure During her life of all other than herein named.
Item I give and bequeath to my Son Samuel Orr my set of black Smith Tools he agreeing to pay out of the rice of them Ten pound at the old rate to my Three Children Viz. Agnes Winfree, Matthew Orr and Christopher Orr to be Equally Divided amongst them and doing the Smith work that may be necessary for the use of the plantatino on freecost ___ complying therewith shall return them in to my wife's possession.
Item at the Deceas of my wife Elizabeth I give and bequeath to my sour Sons Viz. Robert Orr, Daniel Orr, John Orr and Runyan Orr all and Singular my goods and Chattels to be Equally Divided amongst them and by them freely to be Possessed and enjoyed after her Decease for Distribution to be made by Division of Effects.
Item I give and bequeath to my Eight Children Viz. Samuel Orr, Agness Winfree, Matthew Orr, Christopher Orr, Robert Orr, Daniel Orr, Jehu Orr and Runyan Orr all and Singular my Land, Messuages and tenements after my wifes Decease by them freely to be possessed and Enjoyed Each an Equal part and if it may please the Lord to call away any by Death before he heireth his Legacy, the rest Living Equally shareth her part.
And do hereby utterly Disallow, revoke and disanul all and Every other former testaments wills, Legacies and bequests confirming this and no other to be my Last will and testament in witness whereof I have here unto set my hand and Seal the day and year above written.

    This family appears to have come from Wake County, N.C.
    Wake County 1780 will of Robert Orr named Agnes Winfree.
    of Little River in 1801, evidently having moved since 1800.
    It may be significant that the Robert Orr lived on the waters Alexander Orr was in Pendleton as early as 1790 and he and Timothy Orr, who purchased land on Bear Creek of Rocky River in 1801, lived in the part of Pendleton that became Anderson County. The Orr family from Wake County, N.C. is also found in Wilkes and Oglethorpe Counties, Ga.
