Application and Affidavit On 22 Nov 1909, John Mayer Jr., resident of Ilo Nez Perces County Idaho, applied for Lots 1, 2, S1/2 NE1/4 Sec 5, T24N, R5E; E1/2 SE1/4 Sec 32, W1/2 SW1/4 Sec 33, T25N, R5E of Montana Meridian, containing 319.67 acres in the Great Falls Montana land district and swore that he was a native born citizen of the United States, single and over 21 years of age; that his post office address was PO Box 40, Ilo Idaho, that he was well acquainted with the character of the land. Witnesses Otto Maurer and Joseph E. Ross, both of Great Falls Montana, swore that they were well acquainted with the applicant and that his statements were true. Notice of Intention to Make Proof: On 28 March 1913, John Mayer Jr., of Carter, Montana, gave notice of intention to make Final three year proof of claim for homestead entry No. 010828, on which he entered on 16 March 1910, with two of the following witnesses: Ora F. Tate, Charles Prater, Cap Prater, John A. Sheely, all of Carter Montana. Publication of Intent was in the Carter Herald, a weekly, for 5 weeks beginning 7 May 1913 and ending 28 May 1913. Final Proof: Testimony of Witness On 4 June 1913, in Carter, Chouteau County, Montana, Orlia F. Tate, age 37, of Carter, Chouteau County, Montana, says he has known claimant for four years, that claimant is not married, that he settled on the homestead in October 1909 and took up actual residence in March 1910, and has not been absent since establishing residence; that all of the land is cultivable and none is timbered; that claimant broke 40 acres in 1910 and planted to winter wheat but did not harvest in 1911 because he was hailed out, that in 1912 he planted 40 acres flax which was harvested, in 1913 planted 40 acres winter wheat and 40 acres flax and now has 80 acres under cultivation; that claimant has built a house 12x20 and a granary 16x16 ft, and two miles of fence on SW1/4 NE1/4, for a total value of $800; and that witness sees the land and family about 100 times a year. Testimony of Witness On 4 June, 1913, Carter, Montana, Charles Prater, age 26, of Carter, Chouteau County, Montana, stated that he had known claimant for over three years, that claimant is not married, that he settled on the homestead in October 1909 and established actual residence on 15 April 1910 and has resided there continuously since, that all the land is cultivable and none is timbered; that claimant broke 40 acres on SE1/4 in 1911 planted to oats and was hailed out in 1911, planted 40 acres of flax in 1912 and harvested and planted 80 acres of wheat in 1912 for 1913 crop; that he has built a house 14x16, a granary 12x14 ft, and 1 and 1/2 miles of fence for a total value of $500, and that he sees claimant and land about 150 times a year Testimony of Claimant On 4 June 1913, in Carter, Montana, John Mayer, Jr., age 27, of Carter, Chouteau County, Montana, swore that he was a native-born citizen of the United States, born in Pennsylvania, that he was not married, that established actual residence on the land about 15 April 1910 and built his house about 10 June 1910, and has not been absent since; that in 1910 he broke 40 acres on S1/2 NE1/4 Sec 5, planted to oats in 1911 and hailed out, that in 1912 he planted flax and harvested 40 acres, and in the fall of 1912 planted 80 acres of wheat for 1913 crop; that he has built a house 12x16 ft and a granary 12x12 ft, and 1 and 1/2 miles fencing for a total value of $500. Certificate On 23 June 1913, Great Falls, Montana, approval was granted for John Mayer Jr. to receive a Patent for Lots 1, 2, S1/2NE1/4 Sec 5 T24N, E1/2SE1/4 Sec 32, W1/2SW1/4 Sec 33 T25N R5E of Montana Meridian, containing 319.67 acres
