Will Transcript

Jno. Gilmore's Will
In the name of God amen, I John Gilmore of the County of Rockbridge and State of Virginia being in a feeble state of health, but of sound mind and disposing memory do make this my last will and Testament, in manner and form as follows, Viz.
1st I direct after my decease that my body be decently buried in a Christian manner
2nd. Such worldly goods as I have not heretofore disposed of my Deed or otherwise, I give & bequeath as follows to wit:
3rd to my son Thomas I give & bequeath one negro woman a slave for life named Rachel aged about 29 years and her child about two months old called Magdalene, to him and his heirs forever
4th my two waggons, two waggon horses and gear for four horses I give & bequeath to my two sons Thomas & William, to be equally divided betwixt them according to their respective value.
5th I give to my daughter Sarah one Grey Filly & the side saddle& Bridle which she claims.
6th To my daughter Martha Leckey wife of James Leckey I give and bequeath one sorrel filly, side saddle and a bridle, and a Cow then in her possession, I also give her five sheep.
7th To my daughter Magdalene, I give & bequeath, one two year old black colt & one sorrel horse Colt or yearling, together with a side saddle & bridle, now in the house and claimed by her.
8th. My stock of sheep, or Hogs and Cattle on the premises, I allow for the use of my son Thomas, & my daughter Sarah, and Magdalene while they shall remain together on the premises, but if either of them should marry, or otherwise seperate themselves from the rest shall be entitled to an equal distribution in the stock, but not to exceed in value, the stock now on hand.
9th I have by Deed conveyed to my married daughters severally, such beds & bedding & household stuff as I intend for them, such of my beds 7 beding & house hold stuff, as has been made or gathered since my said deed as aforesaid, i give and bequeath to my daughter Martha Lecky & my daughters Sarah & Magdalene, equally, and to be divided equally betwixt them, as stated in the 8th Clause.
10th so much of the estate of my deceased wife as I have rec'd from the Executors of Magdalene Campbell dec'd I have distributed amongst my children as nearly equal as I Could, the residue of that estate which is yet to collect from the Executors when received I direct my executors herein after named to distribute amongst all my children in such manner as shall make their shares of that estate equal.
11th My two old horses, Sam & Bell, I direct that they shall be kept on the farm untill they die, & not to be sold or otherwise disposed of.
11th [sic] If I have not provided in the deed heretofore mentioned for Bureaus for each of my daughters, Martha & Magdelane, I direct that my Executors, shall as son as convenient after the harvest of 1838, provide my daughter Martha with a Bureau, equal in value to the sum of sixteen dollars, and in the following year procure a Bureau of equal value for my daughter Magdelen.
12th The residue of my estate real and personal, which I have not already disposed of in this Will, or by the Deed before referred to, I give to my sons Thomas & William, for the purpose of paying all my just debts & if their [there] be a surplus to be equally divided betwixt them & lastly I do hereby appoint my said two sons Thomas Gilmore & William Gilmore, Executors to this my last will & Testaments hereby revoking & annulling all other wills and testaments by me made, or intend to be made.
In testimony whereof I have hereunto subscribed my hand & seal this second day of January in the year Eighteen hundred & thirty eighht.

The last Will and Testament of John Gilmore dec'd was produced in Court proved by the oaths of John Ruff, Madison Dunlap & John C. Laird the subscribing witnesses thereto and ordered to be recorded ~ and on the motion of William C. Gilmore, one of the executors named in said Will, who made oath thereto, and together with Jacob M. Ruff his security entered into bond in the penalty of $1,000 - according to Law, Certificate is granted him to obtain a probat thereof in due form of Law. ~

Does anyone have any information on a John Gilmore b. 1758 Augusta VA.and wife Magdaline Shepherd. John's parents were Thomas and Elizabeth Thompson.

I believe John had children Thomas, William C., Samuel, Sally, Nancy, Magdaline, Martha, Jane, Frances, and Elizabeth. Does anyone have any other children listed for him? I am looking for a David b. 1797 VA who later resided Tucker co. Va now WVA. Becky

John Gilmore was the son of Thomas Gilmore who was massacred by Indians in 1763 on Kerr Creek, Rockbridge Co., VA. John, his mother and two sisters were captured by the Indians. John and his mother were released but nothing was ever learned about the sisters. Freda
