Will Transcript

Will of James Peyton, Nelson Co., KY, Written 27 March 1789. Proved 9 June 1789
In the name of God, Amen. I, James Peyton, being weak in body but of sound memory and taking into consideration the frailties of man, do make this, my last will and testament.
First, I will that my just Debts and funeral expenses be paid.
Secondly, I give and bequeath to my well beloved wife Susannah the plantation I now live on with all the moveable effects and a Negro named Will her life Time Exclusive of that part whereon my son Elisha Peyton now lives on.
Thirdly, I will that all my land that I own on the waters of Green River be equally divided between my sons and daughters, sons, Elijah, Elisha, Elias, Daniel, and Evan Peyton. Daughters Ruth, Anne, Sucky, Jimimah and Fanny Peyton excep my daughter Anne’s part of said land which is to be Equally Divided between her and her eldest son Peyton Threlkeld.
Likewise will that my son Elijah shall make choice for my son Evan his part of said land to join upon an outside and in a regular form and at the said the Evans death if not sold by him and no lawful heir then to return to the said Elijah, and if he dying without a lawful heir then to be Equally divided between Elias and Dan’l Peyton and Sucky Jimimah and Fanny Peyton.
Likewise I give and bequeath to my son Evan a negro boy named Will after the decease of my wife Susannah till his death. If he dies without a lawful heir he is to Return to my son Elijah and if he dies without a lawful heir then he is to be valued or sold and Equally divided between Elias and Dan’l Peyton and Sucky Jimimah and Fanny Peyton.
I give and bequeath to my son Elisha Peyton one hundred acres of land where he now lives, a part of the Tract of land whereon I now live.
Likewise, I give and bequeath to my sons Elias and Dan’l Peyton the remainder of the said Tract of land after the death of my wife Susannah with all the moveable effects excepting a cow and calf and a feather bed to each of my three daughters Sucky Jemimah and Fanny and to my son Evan and lastly I will that my beloved wife Susannah be my Executrix and my trusty friends James Rogers and Thomas Polke be my executors of this, my last will and Testiment, the word son in the thirteeth line and the word devided between in Eighteenth line was inter lined before the signing and sealing of

At a court held for Nelson County on Tuesday the 9th of June 1789 this will was proved by the oath of Charles Lynch and Will Rogers wittnesses thereto and was ordered to Record.
