Importation to Orange County, Virginia

The following persons appeared in Orange County, Virginia court to claim "headrights". Headrights were grants of 50 acres of land per "head" - or per white male over the age of 16 who transported himself to the colonies. They appear in the Court of Common Pleas in the county in which the land was granted. These headrights function as an immigration record for English, Scot or Irish immigrants in that time period. The headright identifies the country of origin and generally the port of entry in the colonies.

(Note: Martha Mitchell was David's mother. In her will, she is no doubt referring to the Indian troubles that had recently occurred in the South Branch area that David's land was in the vicinity of).

  • Vol. 2 - Anderson vs. Rhea--O. S. 170; N. S. 60--Bill, 1813. Robert Anderson of Botetourt purchased land in Botetourt from William Rhea of Kentucky, which was originally part of five tracts held by David Mitchell, who died twenty or thirty years ago intestate, leaving heirs, viz: James Mitchell, his brother, representatives of two'sisters of whole blood, one named Brownlee and one Tate, and either a sister of the half-blood or her representatives. An informal partition was made and 200 acres were allotted to Mrs. Brownlee's representatives. William Rhea married one of the daughters of Mrs. Brownlee, who had nine children entitled to distribution.

  • DAVID MITCHELL. Of the early grants for land on the Catawba only the Borden grants are earlier than David Mitchell’s first patent for 400 acres on a south branch of Catawba. This special tract was sold to John Ross and proves to be what may yet be known as the old George Edsler place. It embraced the lands and head springs lying north of Greenfield and the present Blacksburg-Fincastle Road and extending towards Haymaker Town. Other land on which Mitchell lived was taken in that vicinity and some lower down the valley on Persimmon Run, later Lapsley’s Run. In 1755 when fortifications were needed for the Catawba settlement the logical place seems to have been the quarters of David Mitchell. At that time the road up Catawba extended from Edward McDona1d’s (now Amsterdam) by the Preston house at Greenfield north over the divide through the Mitchell land, one branch continuing north towards the mouth of John’s Creek (New Castle) and the other going west towards Draper’s Meadows. Here about this fork of the road was built Fort William, which Washington visited when on his tour of inspection. Part of this oldest tract of land was purchased by John Ross, then by George Edsler (1791). David Mitchell’s appraisement was recorded in 1787. His personal property then amounted to £44/3/9. Three of his heirs, William Rhea and Elizabeth, William Mitchell and wife Agnes and Jacob Cault and Abigail, all of Kentucky sold a part of the land to Robert Anderson. In a final division of the Mitchell land James Mitchell was assigned the middle part, 200 acres including the old habitation, John Tate the upper part containing 178 acres and William Brownlee the lower part containing 242 acres. Note: this was followed 3 Sep 1803 by a quit claim by the Brownlee descendants of Green County, Kentucky and James and Mary Tate of Franklin County, Kentucky, assigning their share of David Mitchell's estate to John Tate, who lived in Botetourt.     David Mitchell had to be 21 to make the oath, so he was born before 1718. He was appointed Constable in Beverley Manor 23 May 1745, but he had grants in 1742 and 1744 on Catawba Creek, then Augusta, later Botetourt, now Roanoke County. He built a mill there in 1768. he died in 1787, unmarried and his siblings inherited his land. This was recorded when James Mitchell, who inherited Martha's land in Beverley Manor, sued the other heirs 11 Aug 1791 to establish his share of his brother David's estate. (Botetourt Co. Order Book 8B, page 432].
