Acquisition of Land from Chalkley's:
- Page 349.--29th May, 1761. David Cloyd, Sr., to David Cloyd, Jr., £20, 400 acres on a south branch of Cedar Creek. Teste: Joseph Robinson, James Cloyd, George Alexander.
Will Transcript
- David Cloyd's Will.
- In the name of God Amen, I David Cloyd of Rockbridge County and State of Virginia being Indisposed in Body but Thank God of perfect mind & memory and calling to mind the mortallity of the Body & that I must soon rising my health to others do make & assert this to be my Last will & Testament. I first recommend my sole to God its Giver afterwards this my Body to be buryed in a decent manner as my Executors think fit & to what world good It has pleased God to Bestoe me I Will Bequeath & devise as followeth (to wit).
- I will that all my just Debts be paid within convenient time after my Decease, Unto my beloved wife Elizabeth, I will & bequeath my May mare with the Negro boy Daniel to be at her disposal. Likewise my will is that she have her living off the plantation on which I now Live with the privilidge of the Dwelling House during her natural Life.
- Unto my son David I bequeath the Right & Title of the N.E. End of my plantation including the Improvement, Reserving unto my Son Andrew one hundred and fifty acres off the S.W & End of said plantation which I bequeath unto him to be Divided in manner which will appear most to the Interest of both David & Andrew.
- All my personal Estate I will & bequeath unto my Wife Elizabeth & my son David in Joint Conjuntion between them to be at their disposal & to David my Son I also bequeath my Negro Boy Ralph subjecting to discharge a Bond due from me to my Father David Cloyd for the sum of 71 pounds my Will is that my Wife & my Son David pay unto Each of the Rest of my Children Mail [Male] & Female the Sum of fifty pounds in property, five pounds in Cash to be paid to them respectively as they shall arrive to the age of Eighteen years my will is that in this my house my wife & my son David is to raise up School & Instruct Clofh & Victual all my younger Children Untill the[y] arrive to full age & if my wife or my Son David should die before the Expiration of that time in that case the Children is Intitled to the same previlidges & benefits before mentioned Unto my son James I devise four hundred acres of my Land in Ohio County Six hundred acres of the same Tract the whole being one Thousand acres.
- I bequeath to my son Joseph to be divided according to quantity & Quality paying regard to both my will is that my land laying in Kentucky Consisting of Two hundred & fifty acres be sold to the best advantage & the Price arising from the same be equally Divided & Given to my Daughters (to wit): Martha, Margaret, Polly, Betsy & Sinthey & my Will is that If in case any of my Children should Die while under age in that Case their part of the Estate whithe Rec'd by them or not is to be Equally divided amongst the Surviving Children & I do appoint & Nominate my wife Elizabeth & my son David as my True & Lawfull Executors to Execute this my Last Will & Testament.
- In witness whereof I have hereunto set my hand & Seal this ___ Day of August 1789.
- N.B. this clause was neglected in the above but was asisted her. before it was asign'd. My will is father that my Son Andrew be subjected to pay to my son James & Joseph the sum of Ten pounds in property to Each of them When the Shall arive to full age.
- In Witness whereof I have hereunto Affixed my nand & Seal this 26th Day of August 1789.

- At a Court held for Rockbridge County October the 6th 1789. This Writing purporting the Last Will & Testament of David Cloyd dec'd. was presented in Court by Elizabeth his Widow & David his son Ex'ors therein named Proved by the Oaths of Hugh Barclay Junr. & Joseph Gilmore Witnesses thereto & Ordered to be recorded, & on the motion of said Executors who made Oath according to Law Certificate is granted them for obtaining probate thereof in due form they having together with the said Barclay & Gilmore their Securities entered into and acknowledged bond in the sum of £___ Condition'd according to Law.
