S. 82.--Bill filed 30th July, 1808--Andrew Erwin of Rockingham, died intestate 13th November, 1807; brother Edward, who was exr. of his father's estate. Andrew made no will but confided to his son, John, to make a distribution. He left widow, Jane; sons William, John & James; daughter Nancy. Son Andrew & Mary (Fane). William had removed from the State. Bond 22nd September, 1809--William Erwin, of Fairfield Co., Ohio. [Note: indeed Andrew's brother Edward was the executor of their father John Erwin's estate].
- Evidence of Sibling Relationship: A deposition by Edward Erwin Sr., age 65, given on 16 September 1805 at the home of William Curry in Augusta County, Virginia, identifies Rebecca Stephenson and Samuel Patterson as siblings of Mary Magill. This establishes that Rebecca Stephenson, Samuel Patterson, and Mary Magill were siblings and that Mary was married to a Magill. (Source: Augusta County, Virginia, Jacob Clements Erwin and Andrew Erwin, plaintiffs vs. William, James, and Samuel Patterson, defendants).
