Parentage Conflict

A Geneanet Community Tree claims that this Samuel Curry was a son of James Curry (1752-1834) and Mary Magdalene Burns (1768-1826), but this has been DISPROVEN for the following reasons: 1) they were married in 1784 [six years AFTER Samuel Curry was born], 2) Maria Magdalene was too young to have been his mother [9-10 years old when Samuel was born], and 3) the siblings of Samuel Curry as listed in his will DO NOT MATCH the children of James Curry and Maria Magdalene Burns. Additional research is needed to determine his correct parentage.

Samuel Curry's Estate
Gallia County. Be it remembered that heretofore towit at a court of common please began and held at the court house in the Town of Gallapolis for and within the said County of Gallia on Wednesday the fourteenth day of May in the year of our Lord one thousand eight hundred and twenty three before the honorable Essa? Osborn president Judge, Robert Saffow, Thomas Rodgers & John Holcomb associate Judges of the Court of Common pleas for said County ~
The last will and Testament of Samuel Curry late of this county deceased was presented for probate and therefrow? Mathias Croy and John Hawk the subscribing witnesses thereto came before the court and after being duly sworn according to law declared that they were present when the testator signed and acknowledged the same for his last will and Testament and that they believed he was of sound mind and memory and Judgement and that they signed the same as witnesses in presence of the Testator and of each other, whereupon the same is proved approved and allowed as the last will and Testament of the said Samuel Curry and ordered to be recorded and the same is as follows towit:
In the name of God Amen, I Samuel Curry fellow citizen in Wilkesville Township Gallia County State of Oh[i]o revoking all others appoint this to be my last Will and Testament, I give to my beloved wife Mary Curry my plantation I now live on to be at here at her disposal as long as she lives, I give to my daughter Mary Curry one saddle, I give to my daughter Rebekah Curry one horse and saddle, I give to my daughter Nancy Curry one horse and saddle, I give to my daughter Eloner Burner six dollars, I give to my daughter Sabina Ewin Curry, my share of my deceased broth[er] James Curry's land lying in Greenbrier County state of Virginia now leased to my sisters Polly and Hannah Curry there [their] lifetime and whereas one of my above named sisters has promised to give me one of their shares of said tract of land at their death if so I give same to my daughter Sabina Ewin Curry, I give to my beloved wife Mary Curry all my moveable property bonds and notes after paying my debts and legacys to dispose of to her children as she may think best, I allow my daughters Susannah Curry, Mary Curry, Rebecah Curry, Nancy Curry, Sabina Ewin Curry to live in my plantation and share in the benefits of is production as long as the[y] remain unmaried and no longer, and lastly I give to my two sons John and Joshua Curry my plantation above mentioned to each one equal half after the death of myself and wife yet not excluding my daughters from their privelages above mentioned, I desire my wife Mary Curry to be executrix of this my last will and Testament.
Witness my hand and seal this 13th day of March 1823

and afterwards to wit at the same term on the third day of the Term came Mary Curry executrix named in the last will and testament of Samuel Curry late of this county deceased & having with Anderson Hughes ans John Hawk her securities executed and acknowledged their bond according to law in the penal sum of eight hundred dollars and having been thereupon duly sworn according to law it is ordered that letters Testamentary issue and application.
On motion ordered that Abraham Hawk, Benjamin Hawk and Charles Buck after being first duly sworn according to law do value and appraise in current money of the United States the goods and chattels which were of Samuel Curry late of this county deceased and they are ordered to make return in the clerks office according to the statute in such case made and provided.
