Will of Roger Dyer

"In the name of God, AMEN: This twenty-fourth day of February in the year of our Lord, 1757, I, Roger Dyer of Augusta County in the state of Virginia, being weak in body but of perfect mind and memory, thanks be given to God, thereto calling to mind the mortality of the body, and knowing that it is appointed to all men, once to die, do make an ordain this to be may last will and testament, that is to say, principally and first of all, I give and recommend my soul in the hands of God who gave it and my body I recommend to the earth to be buried in a Christian manner, Executors nothing doubting, but at the Resurrection I shall receive the same again by the mighty power of God. And as touching such worldly Estate wherewith it pleased God to bless me in this life, I give, devise and dispose of them as follows:

  • ITEM: I give and bequeath to my well beloved wife Hannah Dyer, after debts

and charges are paid, the full third part of all my movables, Estaid of goods and grants, whether in this Collony (sic) or any other and one good bed and one good horse or mare which she shall use out of my stock, over and above the third part of the plantation I now live on, until my son, James Dyer, comes of age of twenty-one years, unless my wife marry again, then the plantation to be rented out for the use of my said son, James Dyer; I likewise constitute, make and ordain my well beloved wife my only and sole executor of my last will and testament.

  • ITEM: I give and bequeath to my well beloved son, William Dyer, two shears

(sic) to be equally divided between him and my three daughters after the rest is paid, what is nominated in this will and testament.

  • ITEM: I give and bequeath to my well beloved son James Dyer, the plantation

I now live on, with all the improvements thereunto belonging, and fifty acres serveyed (sic) by itself, adjoining the same plantation I live on and not pattoned (sic) as yet. Messuages [1]and all profits thereunto belonging in anywise and fifty pounds current money with the said lands, to his heirs and assigns, forever.

  • ITEM: I give and bequeath to my beloved daughter, Hannah Gerster [KEISTER?sd], a certain tract of land lying in Hampshire County consisting of 427 acres of land, more or less, to her, her heirs and assigns forever.
  • ITEM: I give and bequeath to my grandson, Roger Dyer, son of William Dyer, twenty pounds current money of Virginia. Now, after all of the above legacies are paid the remainder of my movables is to be divided into five parts and my beloved son William Dyer is to have two parts and my beloved daughters, Hester Patton, Sarah Hase and Hannah Gerster, each of them, one part.

And I do hereby utterly disannul, revoke and disallow all and every other testament, ratifying and confirming this and no other, to be my last will and testament; in witness thereof I have hereunto set my hand and seal the day and year above written."

At court held for Augusta County, March 21, 1759, this last will and testament of Roger Dyer, deceased, was proved by the oath of William Gibson, one of the witnesses thereto and ordered to lie in the office for further proof.

At a court held for Augusta County, May 16, 1859, this last will and testament of Roger Dyer, deceased, being this day further proved by the oath of Adam Hider, another of the witnesses thereto, was admitted to record and on the motion of Hannah Dyer, the executrix, therein named, who made oath according to law, certificate is granted to her for obtaining a probate in due form she having, with Abraham Smith and Ephraim Love, her securities, entered into and acknowledged their bond.
