  • Vol. 1 - MAY, 1768 (A). - Alexander Herron vs. Quin, Ejectment.--Daniel Harrison, 66 or 67 years old, deposes, 16th December, 1767: He was present when Colonel James Woods, then surveyor of the County of Orange (now Augusta) ran the lines in dispute. John Craven, aged 45, says same. William Gregg, aged 30, says same. John Harris was dead at time of taking this deposition.
  • Vol. 1 - MAY, 1768 (A). - Alexander Herron vs. Patrick Quin.--Ejectment. Daniel Harrison, aged about sixty-six or seven, deposes: That he was present when Col. James Wood, then surveyor of the County of Orange (now Augusta), ran off the lands in dispute, and that the first line run by Thomas Lewis this day extends as far, etc., the corner of Samuel Wilkins, and that of Green & Co., under whom said Wilkins claims he has ever since been well acquainted with the lands, etc.; that the lines were not marked until the patent issued, and the reason Wood gave for it was that when he was about to survey the same, he himself was damned drunk and the rest concerned were in same condition, etc. (Signed) Daniel Harrison. 16th December, 1767. John Craven deposes, same time and place (aged forty-five, or thereabouts): He was present when Col. James Wood surveyed the land in dispute, now upwards of 22 years. William Gregg, aged thirty or thereabouts, deposes, same time and place: Samuel Wilkins is dead. Daniel Smith, gent., aged about thirty-seven years: About 12 years ago he was appointed a processioner with John Harrison. Daniel Harrison's additional deposition, 17th December, 1767: He and Alexander Herron bought 200 acres of Samuel Wilkins. Wilkins, after conveying to Herron, found he did not have 100 acres more for deponent and then cancelled the bargain, for which John Wilkins, son of Samuel, paid Harrison £5. Thomas Lewis deposes: That about 1745, talking with Col. James Wood about the difficulty of finding corners on protracted plots when the survey afterwards came to be made, said Wood told this deponent how lucky he had been in a matter of this kind in a plot that he had made for McCay, Hite and Green, on the waters of Cook's Creek, for that he had only run the lines along the courses of the creek and protracted all the other lines and supposed corners which, where an actual survey was made by him after the patent issued, he found trees agreeable to most of the supposed corners which he had mentioned in the protracted plat, or nearly corresponding thereto, which deponent afterwards found to be the case on a survey made by him to detennine a suit formerly depending between the said parties. This day Patrick Quin came, etc., and says that Capt. Daniel Harrison is very ailing; he is afraid that he will soon change his natural life, as he doth believe that he will die very soon.   • Vol. 1 - OCTOBER, 1769 (B). - Nicholas Null vs. John Craig.--Chancery. Bill filed, 1767. Revived, 1768, November. Nicholas Null, orator. Revived by George Null, eldest son and heir. Nicholas Null, late of Pennsylvania, but now of this Colony, came to Virginia, 1750. Applied to William Burk for a piece of land which Burk had bought of James Wood of Frederick. John Craig had a claim on the land. Null was a German. Valentine Pence was brother-in-law of Nicholas Null.

  • Page 86.--21st November, 1772. Mathew Patton to John Likens. Whereas John Reager in his lifetime had purchased of James Wood and Robert Green a tract of land on North Mill Creek, a branch of South Branch of Potowmack, 407 acres, but before conveyance was made, John was murdered by the enemy, Indians, and his son and two daughters carried into captivity; said Mathew administered on the personal estate and obtained a title from Green in his own name. 24th May, 1763. but on condition if the heirs of John should return from captivity Mathew should reconvey the land as by a bond in the hands of James Wood, of Frederick; Dorothy Reager and Barbara Reager, daughters of said John, did some years ago return from captivity, but John Reager, son and heir of John, deceased, has never returned nor has been heard of since he was taken and it is doubtful if he is alive. Dorothy has, since her return, intermarried with said John Likens. Delivered: Jacob Coil per order filed 15th March, 1798.

Thomas Dunkerson and Lucretia Dunkerson, his wife, heirs-at-law of Thomas Moore, deceased, six plantations, containing 1,700 acres. Defendants are Reuben, John and Thomas Moore. Copy of patent by Fauquier to Thomas Moore, 26th July, 1765, 200 acres on Smith's Creek, between Davison's, Philips' and Rambo's lands, Buchanans' Cor. Same by Botetourt to Thomas L. Moore, 12th May, 1770, 190 acres on Smith's Creek, Michael Bowyer's line, Thomas Looker's line. Same by same, to Thomas Moore, 12th May, 1770, on Smith's Creek, corner J. Consideration is importation of four persons, viz: James Porteus, John Poe, Patrick McDonald and Daniel Warner. Patent by Gooch, 12th January, 1746, to James Wood, for 370 acres on Smith's Creek. Patent by Fauquier, 31st October, 1765, to Thomas Looker (Lobker ?) for 68 acres on Long Meadows or North River Shan. Deed by Thomas Loker, of Rockingham, 17th February, 1791, to Thomas Moore, Sr. Thomas Loker. Test: Reuben Moore, Thomas Loker, Jr., Philip Counce, recorded Rockingham, 27th June, 1791. 20th August, 1801, jury, John Carthrea, Jr., George Rader, Jacob Bear, Mathias Anson, Michael Lohr, James Green, George Chrisman, David Caldwell, John Crotzer, Casper Mifford, Evan Thomas, Alexander Graham. Jury find Thomas Moore died intestate, 1797, leaving plaintiff, Lucretia, and defendants, his only children, appeal to Supreme Court, and their appeal dismissed. Judgment for plaintiffs.

S. 64--In spring of 1805 orator's father, Richard Morris, died, owning land on Jackson's River, without devising it, and leaving heirs and children, viz: Orator, James, John, William, Isabella (married to William Elliott), Edward, Frances (married to Archibald Armstrong), Robert, Archibald, Benjamin. William has since died, leaving widow Jean and Children, viz: Jean (married to Edward Jackson and now living in Ohio), William, Richard, Nancy, John, Margaret, Elizabeth, Ann, Benjamin (last 8 being infants). James Morris ha sremoved from commonwealth and lives in Tennessee. John Morris, Benjamin Morris, orators' brother and William Elliott and Isabella have removed to Ohio. Bond 19th October, 1805, by James Morris of Roone County, Tenn. Bond 19th October, 1805, by John Morris of Champaign County, Ohio. Patent to Richard Morris, 18th October, 1787, 46 acres by survey, 1771, on Jackson River. Patent to Richard Morris, 14th July, 1769, 93 acres on Jackson's River in Augusta. Survey by Thomas Lewis, 26th April, 1764, 270 acres (patent of grant, 29th October, 1743, to John Robinson, James Wood and Henry Robinson and John Lewis), now in possession of Arthur Dunlap on Jackson River. Patent by Fauquier, 1760. to William McCutchan, 169 acres in Augusta on mouth of Cedar Creek on Jackson's River. Patent by Thomas Lee to William Jackson, 270 acres on Jackson's River in Augusta, 1750. Patent by Dunmore to Richard Morris, 1772, 110 acres in Botetourt joining William Jackson. Patent by Brooke to Richard Morris by survey, 19th May, 1794, in Bath on Jackson's River. Patent by Randolph to Richard Morris, assignee of Joseph Walker, assignee of Peter Miller, assignee of Joshua Phipps, assignee of Nicholas Pryor, 141 acres by survey, 28th January, 1786, on Jackson River in Botetourt, 17th April, 1788. Bond 6th October, 1788, by James Risk of Rockbridge to Richard Morris, warrants a tract at mouth of Cedar Creek and Jackson River, formerly belonging to Wm. McCutchan and James Risk, whose heir-at-law James Risk is. Deed 7th November, 1772, by William Jackson of Orange County, No. Ca., to Richard Morris of Botetourt, tract on Jackson's River in Botetourt, formerly Augusta, on Jackson's River. Recorded in Botetourt, 10th November, 1772.
  • Vol. 2 - John Ulrick Spore vs. Wood, &c.--O. S. 181; N. S. 64--Bill 1809. Previous to 1st April, 1755, Christopher Tosher (or Dasher) contracted with James Wood, Wm. Russell and Wm. Green for 200 acres on So. Fork of So. Br. Potomac (now Hardy County) and received a title bond in 1757. On 1st April, 1755, Christopher (Christian) transferred to John States, who died before 22d August, 1772, on which day Ann Willson (formerly Ann States, John's only child, who had married Isaac Wilson) transferred to John Gardner. On 21st November, 1777, Gardner sold to Zacharias Smith, who on 11th September, 1779, sold to Martin Gryder, who on 22d February, 1780, sold to orator. James Wood, William Green, Willm. Russell, Christian Dasher and John Gardner are dead. Wood's heir-at-law is James Woods, living in Virginia, and Dasher's heir is Christian Dasher.
