Overview
This article is for Samuel Hays, son of Patrick Hays (1), the Oath Taker.
Birth Samuel is not identified in his father's 1740 oath of importation. That means he was either an adult, and self imported, or he was not yet born. Patrick himself believed to have been born before 1708, and perhaps as early as 1680. Hewould have married by 1726 at the latest. Since he lists five persons (assumed to be his children) besides himself and wife Frances in his oath, the youngest of those could not have been born much after 1736. That suggests that the family importation date was no earlier than 1737, and that Samuel's DOB was after that. Most likely he was born in what was then Lancaster County, and now Londonderry Township in Dauphin County. This date, however, conflicts with other information about the family.
There are 13 records for an adult Samuel Hays in the records of Old Augusta, as documented in Chalkley's Chronicles. There are only five Samuel Hays known to have been living in Old Augusta between 1740 and roughly 1800. Of these, only Samuel (8) would have been an adult during the time these records were made. As a result it is almost certain that all of these records are for Samuel (8). The first of these records occurs in 1753 when he secures a 100 acre parcel on the James River, within Borden's Grant. Assuming he was at least age 21 at the time (the earliest he could have legally owned property), Samuel could have been born no later than 1732. This gives us a date of importation for the family of 1731. That implies that Patrick married considerably earlier than 1726, and that his own DOB is correspondingly pushed back, perhaps to before 1700.
Marriage In 1763 Samuel sells this same 100 acre parcel.

This demonstrates that Samuel had married Elizabeth sometime before 1763. A 1787 record shows that Elizabeth's last name was "Braford".

Elizabeth is believed to be Samuel's second wife, his first wife being Priscilla McClure. The basis for the later identification is unknown.

son Samuel appears in the child list of both wives of Samuel (8). One has a DOD of 1765, and the other a DOB of 1765, so this may be name recycling
How do we know that Samuel (8) died in Donnelson County TN? We have a record for a Samuel Hays in Augusta showing that this Samuel was alive after the supposed death of Samuel (8) in TN. Perhaps these are two different Samuels, in which case who is the Samuel in Augusta late in 1793?

Just a little more on Samuel HAYS. According to WFT CD#2290, (a tree called GROOM, THOMPSON, FOSTER of TX, LA 1653-1995, submitted Jul. 17, 1995), Samuel HAYES, d. bef Oct 1793 in Davidson Co., TN. He married Elizabeth ___________. I believe this is the Elizabeth named in her father's will, along with her son Samuel HAYS, grandson of Samuel Brawford, (will in Augusta Co., VA dated April 21, 1789 listed below). This tree lists the children of Samuel and Elizabeth Hayes of Davidson Co., TN as Charles L, Andrew, Campbell, and Hugh Hayes. It follows the line of Charles L. Hayes, Sr. Of course, I do not have any proof this is the same line, just speculation. This tree goes on to add that Charles L. Hayes, Sr., married Morning ENOCKS (ENOX), dau. of Gabriel Enochs. Charles L. Hayes, Sr. was born "near Nashville" and died 1830 in Russelville, Athens, LA. It appears from will information that this Samuel may have been a son to Patrick HAYS, the immigrant to Orange Co., VA. In addition, Andrew HAYS, son of John and Anne Nancy Christian, also married into the ENOCH family (see below or use "find" button).
