[I] John [should be Francis?] Taliaferro of the County of Glocester [sic] Gent Son and heir apparent of Robert Taliaferro late of the County of Rappahannock . . . for as much as my said deced. father jointly with Lawerence Smith of the County of Glocester did take up and patent 6300 acres of land situate . . . in the County of Rappahannock beginning at the mouth of Snow Creek on the south side of Rappahannock . . . by patent dated 26th March 1666 . . . my said deced. father and the said Lawrence Smith . . . under their hands recorded in Glocester County 16th May 1667 . . . did oblige themselves . . . that if either of them should happen to dye before Division the heirs of him soe dying should have equal right and propriety with the survivor: NOW KNOW YE that I the sd. Francis Taliaferro . . . in consideration of the mutual love and affection which I bear unto my dear Brother John Taliaferro of the aforesaid County of Rappahannock . . . and for the future advancement of my said brother (he being now Intended by the permission of Almighty God to Marry with Sarah the daughter of the said Lawrence Smith) and for other . . . cause me thereunto moving HAVE given . . . and forever confirm unto my said brother John Taliaferro his heirs and assigns 1000 acres of land being part of the above sd. divident . . . to begin at the fork of Snow Creek branch near the path that leads to the fort . . . and runing [sic] into the woods.

To all to whome these presents shall come -- We John Talliaferro of the County of Essex . . . and Richard Buckner of the same, Gentlemen, send greeting . . . Whereas John Lomas of aforesaid County Gentl. and Elizabeth his wife, daughter of Richard Wormley[Ralph] of Middlesex Gent . . . have by their deeds of Bargain and Sale and Lease & Release bearing date the 7th & 8th of July 1704 . . . sold unto John Taliaferro . . . a tract of land . . . commonly known by the name of Portobago situate . . . in County of Essex . . . containing 3423 Acres . . . late in the possession of sd. John & Elizabeth and Gawin Corbin Gentln. of the County of Middlesex . . . and also all that tract of land situate in Petso Parish in the County of Glocester [sic]. . . containing . . . 400 Acres . . . late in the possession of Samuel Smith and Anne his wife which was formerly given to the sd. Elizabeth now wife of the sd. John Lomax by Thomas Dawkins decd. formerly husband of her the sd. Anne Smith . . . sold unto the sd. John Taliaferro to the intent [of] limitations therein . . . and whereas by deed of release the estates of sd. several . . . tracts are limited to me Richard Buckner . . . for the natural lives of sd. John Lomax and Elizabeth his wife in trust . . . We John Taliaferro & Rich: Buckner at the request and desire of John Lomax & Elizabeth . . . revoke the uses limited by sd. several deeds concerning the lands . . . on lower side of Portobago Creek . . . to the use of John Lomax and Elizabeth in absolute estate in fee simple . . . as the same was held and enjoyed before the passing of the several deeds of Bargain & Sale.

The will of John Taliaferro was dated June 1, 1715 and was probated June 21, 1720 (W.B. #3, p. 159). He was of St. Mary;s Parish, Essex County. To his sons Lawrence and John he left the plantation he lived on and negroes. To daughter Mary a ring of 20 shilling value. To daughter Elizabeth 78 pounds sterling, part of a portion presented to her on marriage. To sln Charles 300 acres and one moiety of a tract of land taken up and patented in partnership with brother Francis Taliaferro, dec'd. To son Robert 675 acres, one moity lying in Golden Vale Swamp. To son Richard one moiety of land he (testator) lived on. To son William, after the decease of his (testator's) wife, the other moiety of this land. Son John to make sure the lower moiety of land sold to deceased brother Francis, deed for same not having been recorded. "My will is that my whole Estate be equally divided among my loving wife and 7 children (Viz.) Charles, Sarah, Robert, Zachariah, Catherine, Richard and William. All of these equal parts to be severed from the other until the owner arrive at the age of one and twenty, or the girls be married. I appoint my sons Charles, Robert, Zachariah, Richard and William Executors of my Estate." Witnessed by John Sutton (who died before the will was probated), Thomas Evans and Henry Brice.
