Botetourt County, Virginia, Order Book 8B, page 432: James Mitchell vs. Samuel Patterson & Martha his wife, John Moffet & Jane his wife, representatives of Agnes Ledgerwood, dec'd, formerly Agnes Mitchell; William, James, John, Margaret, Martha & Sarah Brownlee, Wm Reak & Elizabeth his wife, William Mitchell & Agness his wife, and James Brownlee, only issue of Alexander Brownlee, dec'd, who were representatives of Sarah Brownlee, dec'd, formerly Sarah Mitchell; James Tate & John Tate, representatives of Elizabeth Tate, dec'd, formerly Elizabeth Mitchell.
[Note: This was followed 3 Sep 1803 by a quit claim by the Brownlee descendants of Green County, Kentucky and James and Mary Tate of Franklin County, Kentucky, assigning their share in David Mitchell's estate to John Tate, who lived in Botetourt. & John Tate and Susannah his wife later sold the land.]

    James Tate of Botetourt County married Mary Lloyd in 1783, and moved to Franklin Co., Kentucky. This is the James Tate (1756-1831) clearly identified as the brother of Joseph Tate (1746-1821) of Warren County, Ohio, in Joseph's will. Since Joseph was not listed in the above proceeding, it must be concluded that he was a half-brother of James, by a prior marriage of their father prior to his marriage to Elizabeth Mitchell.
