James Fernihough was baptised on 8th April 1690 at Marton in Cheshire, son of Ellen Fernihough, formerly Thompson, and her husband John Fernihough, a yeoman. Marton was a chapelry within the larger parish of Prestbury at the time.

In November 1713 James was party to a marriage bond allowing him to marry a Mary Hibbert. According the bond Mary lived at Rainow, a hamlet in the parish of Prestbury, near the town of Macclesfield. James was described as a yeoman. His brother Thomas acted as bondsman for them. The bond allowed them to marry at either Astbury or Siddington, although no record has been found to confirm where they actually married.

Mary and James lived at Rainow after their marriage. They had a daughter called Elizabeth in 1714 and a daughter called Ellen in 1716. Both were baptised at another nearby village, Pott Shrigley, but were described as being "of Rainow" on their baptism records.

By 1720 the family was living at Sutton, just south of Macclesfield. Sadly Mary and her younger daughter Ellen died about the same time; both were buried on 21st January 1720 at Macclesfield.

Back in Marton, James's mother died in 1725. James appears to have returned to Marton. He died at the age of forty, being buried at Marton on 22nd April 1730. His father outlived him.

Signed and sealed the third day of November in the 12th year of the reign of Anne by the Grace of God of Great Britain, France and Ireland, Queen, Defender of Faith etc. Anno Domini 1713]

    THE Condition of this Obligation is such, That if there shall not hereafter appear any Lawful Lett or Impediment, by Reason of any Precontract Consanguinity, Affinity, or any other just Cause whatsoever; but that James Fernihough of Marton within the parish of Prestbury above-named and Mary Hibbert of Ranoe of the parish of Prestbury aforesaid Spinst[e]r may lawfully Marry together; And that there is not any Suit depending before any Judge, Ecclesiastical or Civil, for or concerning any such Precontract; And that the Consent of the Parents, or other the Governours of the said Parties be thereunto first had and obtain[e]d: And that they cause the said Marriage to be openly solmniz[e]d in the Face of the Parish-Church of Astbury or Chappel of Sydington between the Hours of Eight and Twelve of the Clock in the Forenoon: And do and shall save harmless, and keep indeminfied the above-named Reverend Father in God William Lord B[isho]p of Chester his Surrogates, and all other his Officers and Successors in Office, for and concerning the Premises. That then this Obligation to be void and of none Effect, or else to remain in full Force and Virtue.
