Whereas Margaret Dawson widow of the Township of West Caln and County of Chester died Intestate leaving a considabrell Estate Real and personal therefore we the Subscribers children of the said Margret Dawson do hereby renounce all our Right of Administrating to said Estate and pray you to appoint Robert Miller Esqr in our room and stead. Writ and inquisition on the Estate of Margaret Dawson, late of West Caln, dec’d.

The Petition of Jane Dawson one of the Children and Heirs at law of Margaret Dawson late of the Township of West Caln in the County aforesaid deceased, Respectfully sheweth,''That your petitioners said Mother Margaret Dawson died intestate in the year 1805, leaving issue as follows viz—William Dawson (since dead having first made his last will and Testament whereby he divided his undivided share of the Plantation hereafter described to Margaret Dawson & Jane Dawson your Petitioner in fee), the Children of Rachel Thompson late Rachel Dawson, the Number and names of whom to your Petitioner is unknown residing in the state of South Carolina, Elizabeth Dawson, Ann Intermarried with Robert Patton, Mary Intermarried with John McConnell, Margaret Dawson & your Petitioner Jane Dawson. And that the said Intestate died seized in her Demence as of fee, of and in a certain messauge and plantation or tract of land containing two Hundred & fifty acres and the usual allowance situate in the township of West Caln aforesaid, with the appurtenances, Your Petitioner therefore humbly prays your Honour to award and Inquest to make partition of the Premises aforesaid to an among the Children and Representatives of the said Intestate, in such manner and in such proportions, as by the laws of the Commonwealth is directed if such partition can be made without prejudice to or spoiling the whole, but if such partition cannot be made thereof as aforesaid, then to value and appraise the same, and make report of their Proceedings herein according to Law, And your Petitioner, Jean Dawson.

Report of Jesse John, Esq., “High Sheriff of the County of Chester” and the “twelve free and lawful men of my bailiwick” in which they value the real estate at $7,500 and that that the land could not be partitioned “without prejudice to or spoiling the whole.”

The Petition of Jane Dawson one of the Children and Heirs at law of Margaret Dawson late of the township of West Caln deceased Humbly Sheweth
That such proceeding hath lately been had in your Honourable Court relating to the Real Estate of the said Margaret Dawson deceased who died intestate. That the Inquest heretofore awarded, hath valued and appraised the same at the sum of Seven thousand five Hundred dollars lawful money of Pennsylvania, which valuation has been confirmed. Whereas none of the Heirs or Representatives of the said deceased have elected to accept the said Real Estate at the Valuation aforesaid but have heretofore refused so to do. Your Petitioner therefore prays your Honour to grant a “rule upon all the Heirs or other persons interested in the said Estate to shew cause on the first day of the next regular Session of said Court Township on the 1st day of February next at the Court House in West Chester why the Real Estate of the aforesaid Intestate should not be sold” according to the provisions & directions of the act of Assembly… Jean Dawson' Rule upon the Heirs and other persons interested in the estate of said deceased, to shew cause at an Orphans Court to be held at the Court House in the Borough of West Chester for the County of Chester, on the first Monday in February next, at ten o’clock in the forenoon of that day, why a certain messuage, plantation and tract of land, containing two hundred and fifty acres and the usual allowance, situate in the Township of West Caln aforesaid, with the appurtenances, the real estate of said deceased, valued by an Inquest awarded by the Orphans Court of said County, at the sum of seven thousand five hundred dollars, should not be sold by the Administrator of the estate of said deceased, agreeably to the directions of the Act of Assembly of the Commonwealth of Pennsylvania

Robert Miller Esquire being duly affirmed according to Law doth say that he read the within Rule of Court to Margaret Dawson more than thirty days ago she being the only Heir or person interested in the within Estate residing in the County of Chester (except Jane Dawson the Petitioner) this affirm and further saith that a copy of said Rule certified by the Clerk of this Orphan Court was published four successive weeks to wit on the 25th of December 18097 and on the 1st 8th & 15th of January 1808 in the Lancaster Journal there being no newspaper printed in the County & that being one of the Newspapers published nearest to said County—and further this affirmant saith not.
