In the name of God I John Mitchel of Montgomery County and the state of Kentucky being sick of body but perfectly sound of mind do recommed my sprite to God who gave it and my body to be buried in a christianlike manner,Do by these pursuits constitute make and declare this my last will and testament in manner and form following towit, First I allow all my just and lawful debts to be discharged out of my Estate.

Then one third of the profits of the farm where I live I give and bequeath to my wife Elizabeth Mitchel for her lifetime

Also one third of my personal property to be disposed of as she thinks proper

Then I give and bequeath to my son Robert all this lower purchase where I now live saving to my wife what is above named, also I give him my waggon and gears and all my farming utensials likewise the use of all the stock on the farm for the benefit of family
Then I give and bequeath to my sons Matthew and James all my upper purchase wher my son Matthew now lives to be equally divided between them if James does not chuse to take the land then Matthew is to have the whole of it and to pay James two hundred Dollars in cash-
I give to James the horse which is called to him-
my three youngest daughters are to be at the discretion of my Executors and particular regard is to be had to my daughter Rachel about the other two on account her infirmities
To my grand son Archibald Ramsey I will to have an Horse worth Twenty Pounds also a saddle and Bridle together worth fourteen Dollars,also a Decent suit of country made Cloaths all to be deliverd to him when he comes of age
To my son John Mitchel + daughters Jennet + Martha I give six shillings each. [Presumably this is a bequest to Jennet and Martha, daughters of his son John.
I appoint my wife Elizabeth Mitchel an exacutrix and Robert Mitchel + Andrew Gudgel Exr,s

This I acknowledged and Ratify as my last will and Testament made this 4th day of April in the year of our Lord One thousand Eight hundred and four

At a court held for Montgomery County the 7th day of May 1804
This last will and testament of John Mitchel Decd was proven by the oath of Jas Breckenridge Thos Mitchel + Jno Todd junr thereto subscribed and ordained to be recorded Elizabeth Mitchel Robert Mitchel + Andrew Gudge the Executors therein named qualified according to law and who together with Robert Breckenridge,Thomas Fletcher + Alexander Simpson their securities entered into and acknowledged their bond in the in the sum of four hundred pounds conitioned for the true and faithful administration of the said Decedents Estate + performance of his will and therefore a probated thereof is granted them in due form.

Believe your John Mitchell was born ca 1737 Lancaster Co., PA the son of John Mitchell and Elizabeth Wilson. John Sr. was the son of Thomas Mitchell and Eleanor. John Sr. was born ca 1709 Ireland, will proved 20 Aug. 1771 Augusta Co., VA. Father Thomas was born ca 1670 Ireland, died Oct. 1734 Lancaster Co., PA. John, Jr. had a brother, Robert,who died in Woodford Co., KY in 1810.
