Alabama Death Records, Vol 32, Cert-15548, Role 6 list "James R. Nix" from Escambia County, Alabama. Other data fit James Russell and it is considered possible that some one could have read "Etowah County" as "Escambia County".

Updates by Dan Nix, son of Harvey. He visited me in Madison with my sister Earlene (Nix) Stanfield on 7 July 2003.

He insisted that Jim moved to Brewton in South Alabama in the late 1940's , even in the face of my arguing that he Was burried at Moodys and that he lived in Altoona with his children in all the census.

Dan was correct, he moved to South Alabama but died a few years latter and was returned to Etowah County and buried at Moodys.

James R Nix 15 Dec 1879 White Not Stated, Etowah, AL

James (Jim) Russell Nix was the second son of Harrison Jennings Nix and Louiza Penitas (Netie) Conn. He was the grandson of Daniel, and the great grandson of Jennings. The 1900 census shows him living in the NIX community , but not at home. He was living down the road in the house hold of Gus Humphries and Melcenia C. Bynum with the family designation of "servant". But by 17 June of that year he is married to a daughter of that family, Fannie Viola Humphries. He is married with three children of his own. By the 1930 census he is 49 years old and they have seven children. He is living at the 42th residence along Warrior Road. That is not like a house number, only indicates that it is the 42th house that the enumerator has visited on Warrior Road that census year. By this time, however, he has been elevated in status and is listed as "Head". In the early part of the 20th century, at least in that region it was common practice for farmers to purchase on credit until the crops were sold in the fall. The weekly or monthly purchases were maintained on a ticket until they reached a certain large balance, maybe $10.oo and then the balsnce was transferred to a note on the only thing of value that they owned, their property. That is how the following legal announcement came to be posted in the Gadsden newspaper. SHERIFFS SALE Under and by virtue of a vendi- tioni exponas and fleri facias in my hands issued from the City Court of Gadsden, Etowah County, Ala., against J.R. Nix and in favor of A. E. Fields, I will proceed to sell on Monday, the 31st day of December 1906, at the court house door of Etowah county, between the legal hours of sale, the following describ- ed property of the said J.R. Nix, to- wit: An undivided one-seventh (1-7) interest in se1-4 of nw1-4 and ne1-4 of sw1-4, Sec 12, Tp. 12, R3 east, and ne1-4 of nw1-4 and wm1-4 of ne1-4, Sec. 12, Tp, 12, R. 3 east, s 1-2 of nw 1-4 of se 1-4 and se 1-4 of sw 1-4 and sw 1-4 of se 1-4 Sec. 1, Tp 12, R3, east on Etowah County, Ala. This 20th day of November, 1906, Wm. Chandler, Sheriff of Etowah County This property was the 320 acre farm that his father, Harrison Jenning, owned and that had been passed down to the family at his death. I think that a modern day lawyer may question how it would be possible to sell an undivided one seventh interest in a 320 acre farm, but it appears the Sheriff attempted to do just that. I have several letters between family members discussing what they should do. Jim was living in DeKalb County at this time and he said he would love to help, but "I do not have a penny to my name". Another described that Jim's older brother Daniel and their grandfather Daniel were to "go to Gadsden next week to see what could be done". Apparently they were successful because the property stayed in the family. Jim list his date of birth as 15 Dec 1879 on the registration card, but I have a hand written note by his mother listing all the children's date of birth. She has 15 Dec 1880 for Jim. But her document was not completely correct either, she misspelled the names of three of her children. His physical features were listed as: Height - Tall, Build - Slender, Eyes - Blue and Hair - Red. That makes two RED hair Nix boys and may explain my own daughter having red hair.
