Will of James Kerr
In the name of God, amen.The 19th day of May anno domini, 1748
I James Kerr of Paxton Township, and county of Lancaster being very sick and weak in body but in perfect mind and memory thanks be given to God for the same, calling to mind the mortality of ye body and that it is appointed for all men once to die do make and ordain this my last will and testament.
First of all I give and recommend my soul into the hands of the Almighty God that gave it, and my body I recommand to the earth to be buried in a christian like decent manner clothing doubting but that at the general reserection I shall receive the same again by the power of Almighty God; And is touching such worldly substance as it hath pleased the Lord to bless me with in this life, I give and dispose of the same in the following manner and form.Imprimis I order my funeral charges and all my just debts to be discharged and payed of the whole of my estate and effects.
Item I give and bequeath to my son John, a horse, saddle and bridle viz either the black horse or the sorrel mare.
Item I give and bequeath to the rest of my children, viz Joseph, William, Mary, James, and Nathaniel, the rest of my estate, goods and chattels to be equally divided amongst them.
Item I constitute and appoint James Morrison and Thomas Elder the whole and sole executors of this my last will and testament to take ye management of my affairs and divide and dispose of my worldly substance according to the above directions And I do hereby disanull and revoke all and every other former wills, testaments bequests or executors by me in anywise before this time named, willed and bequeathed.Ratifying and confirming this to be my last will and testament.

Published, pronounced and declared by me the above said James Kerr the day and year above written, in the presence of the under signed witnesses.his Witnesses present James x Kerr Thomas Farrell, George Galloway mark This day Thomas Farrell and George Galloway appe[a]red before me this day and when asked on the holy bible declared on the oath that they were present when the said named James Kerr deseased signed the within will and exnoleg the within will to be his las will and testament and that he the said Kerr was then in his perfect mind and memory when he si[g]ned the within will this as our edines this 27 day of July 1748.

Deed in Lancaster County, PA, dated 28 Feb. 1757, John Kerr & Al to William Kerr
We the subscribers of the deceased James Kerr and Margt. Kerr of the Township of Paxton in the County of Lancaster do acknowledge to have recd. from William Kerr of the Township and County aforesaid full satisfaction for all legacies bequeath'd to us by our late fath. & mother in their respective Wills and Testaments and to acquit and release the said William Kerr from all claims or demands to be made by us or any of us in regard to said legacies action or actions law suits or otherwise that may be commenced agt. sd. Willm. Kerr by us as Witnesses our hands and seals this 28th day of Feby. 1757.

James Galbreath Esquier being swown according to Law down depose and say that he was present and seen the within named John, Joseph, James and Nathaniel Kerr and Thos. Dougan son in Law to James Kerr dec'd sign and seal the within Instrument of writing and he subscribed his name as evidence and seen Thos. Forster sign his name and evidence the within releas.
