  • Vol. 2 - Stealey vs. Waggoner--O. S. 192; N. S. 68--In 1772 John Gillihan made a settlement in now County of Wythe and sold to Henry Waggoner, who on 6th February, 1775, obtained a survey under the Loyal Company for 476 acres and then sold to Jacob Hetrick, who sold to orator, Martin Stealey, before 12th September, 1782, and on that date Martin obtained a certificate from the Commissioners. In 1798, by some mistake, the grant issued to Henry Waggoner, who is now dead, leaving heirs and representatives, viz: Henry, Michael, Jacob, John, Lewis, Lindsay, Catherine, Barbara, Margaret, Susannah Waggoner, Henry, Lavinia, William, Jerry, James, Sally, Catherine and Betsey Newland. Spa. 8th September, 1809. All defendants (except James and Betsey Newland?) are non-residents.

    Henry Waggoner I (or Henry Sr.) was born about 1733 in Germany and came to America about 1751. He settled in Augusta county, Virginia which was later named Russell County, Virginia. He and his son, Henry II (or Henry Jr.), both served in Captian Doak's Company of the Fincastle Militia in Virginia during the Lord Dunmore's war in 1774. (See Henry Waggoner's Military Page) Henry Sr. purchased 476 acres from John Gillihan in Wythe County, Virginia. Among his heirs listed in 1809 were Henry Jr., Michael, Jacob, John, Lewis, Lindsay, Catherine, Barbara nd Margaret Waggoner. Jerry, William, James, Sally, Cathrine and Betsey Newland were also listed.     Henry Waggoner, Sr. and his son, Henry Waggoner, Jr., were listed on the muster rolls of Captain Doak's Company of Fincastle Militia. Both Henry and Henry Jr. took part in the Battle of Point Pleasant.

    One can understand why the Waggoner’s are listed as heirs to Henry Sr., the question is raised as to why the Newlands are listed as heirs. The answer to the question is the Newlands that are listed as Henry Sr. Heirs are his grand-children. Savina Waggoner was Henry Sr.’s oldest daughter and she married a widower by the name of John Newland. John Newland was a neighbor and friend of the Waggoner’s. He served with the Waggoner’s in Lord Dunmore’s War. He also served with Henry Jr. in the Revolutionary War. His wife died between 1776 and 1780. He married Savina in about 1780 and together they raised ten children. Savina died in 1801 when the youngest of their children, James, was only one year old.
