- Daniel Moffett's Will
- I Daniel Moffett of the county of Culpeper being somewhat unsuall and knowing the uncertainty of life and the certainty of death, do make this my last will and testament in the following form and manner to wit.
- First it is my will and desire that the whole of my estate both real and personal should be kept together and managed in the best manner for the interest of the whole of my children during my wifes life and widowhood and that my wife shall be empowered and authorised to give off at valuation to each child as much of the said estate as can be conveniently spared.
- Secondly I give and bequeath unto my wife Mary Moffett a negro girl named Betsy and her two children Luticea and French with their future increase during her life and after her death to be equally divided among my fous sons Walter N. Moffett, John Moffett, Horatio G. and Hugh F. Moffett.
- Thirdly, I give and bequeath unto my two sons John Moffett and Hugh F. Moffett over and above an equal portion of my estate, in consequence of their infirmities, to John Moffett, one negro boy named Abner or one hundred pounds cash, as the said John Moffett may choose and unto Hugh F. Moffett a negro girl named Mary and future increase forever: and unto my son Horatio G. Moffett, over and above an equal portion of my estate two hundred dollars and my silver watch.
- Fifthly in the event of my wife's marriage, it is my will and desire that she shall have that part of my estate that the law would give her and that the balance of my land should be rented out until my wifes death at which time I wish my executors hereafter named to sell the whole of my land and divide the money equally among all my children and the balance of my property of every kind and description to be sold or devided as my executors may think most advantageous.
- I give my executors full power to dispose of any of my negroes who may become turbulent and unmanageable.
- Sixthly and lastly I do hereby constitute and appoint my wife Mary Moffett, my executrix and my three sons John Moffett, Horatio G. Moffett and Hugh F. Moffett executors to this my last will and testament.
- In witness whereof I have hereunto put my hand and seal this 13th day of August 1831.

- I do hereby certify that I have advanced to Thomas A. Moffett eight hundred and fifty dollars which is to be deducted from his part of my estate. Witness my hand this date above written.

- I do hereby certify that I have paid Horatio G. Moffett Tow [s/b Two] hundred dollars which I consider the legacy I left him I left him in the written will as to witness my hand this date above written.

- In Culpeper County court 21st October 1839:
- This last will and testament of Daniel Moffett was produced to the court and proved by the oaths of George Ficklin and James Smith two of the witnesses thereto, and the two codicils thereto was proved by the same witnesses and my Joseph N. Faut? to be wholly written in the testators own hand writing whereupon to said will and the codicils thereto were ordered to be recorded. And on the motion of John Moffett one of the executors therein named, who made oath thereto and together with George Ficklin, H.G. Moffett, Charles Brown and George W. Starke his securities entered into and acknowledged a bond in the penalty of thirty thousand dollars conditioned according to law: a certificate is granted him to obtain probat thereof in due form.
