- Court Records of Thomas Hamilton Adm. Vs. Thos. Hamilton heirs filed May 9, 1850
- To the honourable Judge of the Adair Circuit Court in Chancery Sitting: Your Orator Hugh Thomas Administrator of the estate of Thomas Hamilton dec'd. Would beg leave most respectfully to represent unto your ??? . That on the ? Day of January 1850 Said Thomas Hamilton, who ??? resided in Adair County, departed this life intestate, leaving no widow And at the February ??? of the Adair County Court your Orator was duly & legally appointed by Said County Court which then had full power and authority by law, So to do. Administrator of Said decedents estate & he executed bond & took the oaths required by law in such cases & took upon himself the Administration of Said estate, as will more fully appear by reference to a duly authordicated copy. Of said appointments & proceeding before Said Count Court, which is here filed & made part hereof.
- Your Orator States that the whole of Said decedents estate which came into his hands as the Adm. Of sd. Has been disposed of by public Sale on a credit of ------ months. except the cash notes, & eight Negro slaves (viz:) Hannah, Louisa, Mariah, Jane, Thomas, George, Lucilla & Lina: And that a correct list of Said Sales will, in due time be filed, herewith & when filed he makes it part of his bill: Said Sale list amounts ?? the aggregate to the sum of $???. The amount arising from cash notes or Solvent ???? & which can be collected is $???? which amount together with the Sale list is, in his opinion sufficient to finish paying his debts which may yet be outstanding against said estate.
- Your Orator States that owing to the great inequality in the value of Said Slaves - Some of them being quite young & of but small value - others being in the vigor & meridian of life, are worth a larger amount - and some (or at least one) being advanced in age & worth Still less than other, that it would be very difficult if not impossible to divide them in kind amongst the heirs of said decedent, in such manner as to five to each a just & proportionable share. And he State that he is informed & believes, that Merit Hamilton, one of the heirs of Said decedent, is setting up some sort of claim or pretended claim, or title to Said Slaves, and that it is impossible for your Orator to divide or distribute Said Slaves amongst the heirs on account of their great inequality in value, and on account of the antagonistic & conflicting claims of the heirs, of said decedent, to Said Slaves. He states that Said Slaves came to his hands as the property of sd. decedent.& are still in his possession, & that he can not divide, or distribute them, or dispose of them in his ????????? capacity, Such being their disparity in value, & the conflicting claims or pretended claims, set up amongst his heirs of Said decedent concerning them.
- Your Orator therefore prays to make a full & complete settlement as the Adm. Of sd. With the heirs & distributes, of said estate, and in view of that he will in due time exhibit & file herewith, a true & correct schedule & statement of the property which came to his hands, & the amount due from him as the Admin. of sd to said heirs; and also a list of statements of the credits (&the vouchers for the same) to which he is entitled in Said settlement & makes them part of his bill.
- Your Orator States that said decedent left at his death the following children & heirs at law (viz:) Rebecca Scaggs, late wife of Charles Scaggs dec'd, --- Merit Hamilton --- John Hamilton --- Nancy Caldwell, wife of Henry Caldwell --- Amanda Dawson;, late wife of Sydney Dawson dec'd. All of whom are residents of this state. And Lucy Caldwell wife of John Caldwell --- Levi Hamilton ---, and Preston Hamilton & Anderson Hamilton heirs at law of David Hamilton dec'd, Said David being a son and heir of said Thomas Hamilton dec'd. ---and the unknown heirs of Jesse Hamilton dec'd. Who was also a Son & heir at law of Said Thomas Hamilton dec'd. who are non residents of this State. Your Orator prays that Said Rebecca Scaggs, Merit Hamilton, John Hamilton, Nancy Caldwell and her husband Henry Caldwell, Amanda Dawson, Lucy Caldwell & her husband John Caldwell, Levi Hamilton, Preston Hamilton, Anderson Hamilton, and unknown heirs of Jesse Hamilton dec'd may be made parties to the bill & that process may be awarded against each of them requiring them to appear & answer this bill.
- And upon the final hearing of this case your Orator prays that a full & complete settlement may be made of Said estate in your Orators hands. As afsd. And that your honor will make such allowance to your Orator out of said estate as may be just, for his services as Adm. Afsd. And make such orders & decrees & disposition concerning Said eight Salves, & their distribution, & the distribution of Said estate as may seem just & equitable. And grant such other & further relief as may comport with this ???? of equity & as is duty bound he will ever pray

Of the estate of Thomas Hamilton dec'd, Rebecca Skaggs, Levi Hamilton, John Hamilton, Lucy Caldwell & John Caldwell, her husband, Nancy Caldwell & Henry Caldwell her husband, Amanda Moss & Wm. E. Moss her husband & Preston Hamilton & Anderson Hamilton children heirs at law of David Hamilton dec'd. And Mary Anne Stone and --------- Stone her husband and Lucinda Wilhite and ------- Wilhite her husband, Presley Hamilton and Thomas Hamilton children & heirs at law of Jesse Hamilton dec'd. James Hamilton, Jackson Hamilton, & Moses Blakeman take notice that on Saturday the first day of November next I shall proceed at the dwelling house of John Yates Esq. In the County of Adair in the State of Kentucky to take the depositions of William C. Skaggs and others to be read as evidence on the trial of a suit in Chancery now pending in the Adair Circuit Court wherein Hugh Thomas Adm. As afsd. Complainant and you are defendants on cross bill. And shall continue from day to day Sundays excepted until completed At which time & place you can attend if you see proper.
