"Know all Men By These Presents That:
WHEREAS David Hamilton, formerly of the State of Virginia, deceased, who died near New Bern in the State of North Carolina, leaving Thomas Hamilton, Margaret Hamilton, Ann Hamilton, Martha Hamilton, Hance Hamilton (now deceased), his heirs and representatives, and a considerable property which is now probably in the hands of the executors appointed by th will of said David Hamilton, and in their hands of a certain William Gilmore of North Carolina, or in the hands of their respective representatives in care of the deceased. Now comes Abraham Burner and Margaret Burner (formerly Margaret Hamilton, above named), Samuel Wells and Ann Wells (formerly Ann Hamilton, above named), and Lewis Wells and Martha Wells (formerly Martha Hamilton, above named), with the above named Thomas Hamilton, stating that they are the surviving heirs of the said David Hamilton..."
