Before the Plymouth County Court, Josiah Conant and his wife were fined £4 for “Carnal copulation before marriage” as “convict by confession.” (Mayflower Families Through Five Generations, vol. 12, Francis Cooke)

Josiah Conant died intestate. Inventory of his estate was taken 11 October 1721. The estate was divided, on 1 June 1729, among the widow Elizabeth; sons Joseph [eldest] and Josiah; daughters Jerusha [wife of Samuel Pratt], Mary Cobb [wife of John Cobb], Prudence Conant and Susanna Conant.

In letters of guardianship dated 13 April 1726, John Alden of Middleborough was named guardian to Joseph, Susanna, Prudence and Josiah Conant. On 21 September 1737, Josiah Conant chose his mother, Mrs. Elizabeth Conant of Middleborough as guardian.
