Davis. 3) DEATH: In 1770 an Aaron Davis was appointed a guardian and there is a probate record in August 1769 for a John Davis of Brookfield. A warrant of appraisal is dated 28 August 1769. E-mail 23 April 2007 from Katie Fenton <katiefent@yahoo.com> states: The warrant for partition of John DAVIS's estate (Vol. 13 of Worcester co probate dockets, dated 20 Apr. 1771) indicates that John Davis jr was to pay 8lbs, 5sh, & 11p each to 4 brothers, 3 sisters, and to "the heirs of his sister, Elizabeth Phelps, their guardian or legal representative." Eliakim Phelps signed an agreement in May 1771 as "heir of the estate of John Davis, late of Brookfield," and "Eliakim Phelps of Belchertown" was named in Apr 1771 as guardian of the "children and heirs of Elizabeth Phelps, late of Belchertown. . . deceased." (Hampshire co. probate records, Box 113, #10) - including minor daughter Lucy. Taken together, these are adequate proof that John Davis's daughrter, Elizabeth, was wife of Eliakim Phelps of Belchertown, and that she was deceased by Apr 1771. 4) PROBATE: Administration of Estate John Davis in 1772. Worcester Co., MA, dated 9 March 1772, series A, case #15919. Document names all children of John Davis and his wives Elenor and Elizabeth. Son John is bequeathed twice as much as the other children.
