This Indenture made this nineteenth day of September in the year of our Lord one thousand eight hundred and seven. Between Henry St. John Dixon and Jane Todd, Guardians of Thomas Todd, Robert Todd and Mary Todd, heirs of James Todd dec'd and the sd. Jane Todd as well as for herself as Guardian for the said Thomas, Robert and Mary Todd and in obedience to a decree of the Court of Washington County pronounced on the final hearing of a suit in Chancery depending in the said Court wherein John Todd was plaintiff and the said heirs of James Todd deceased were defendants do the said Henry for the said Thomas Todd, Robert Todd and Mary Todd, heirs of the said James Todd deceased and the said Jane Todd doth for herself and for the aforesaid Heirs by these presents convey in fee Simple unto the said plaintiff John Todd according to the aforesaid decree all that tract or parcel of land mentioned in the said Complainants bill and bounded as followeth to wit: Beginning at a Black oak and Two White Oaks on a line of the old survey and Corne[r] Between Sd. Todd and Jamison and for a dividing No. 35, E82 poles to a Stake in the Orchard thence North 127 poles to a small hickery in the field N16, W44 poles to a Stake in the Edge of a sink hole N2, W59 poles to 2 blased White Oak on a ridge in a line of Jamisons Land and with the same South 54 west, 222 poles to a small white oak South 55½ East, 180 poles to 3 white oaks South 70, E74 poles to the Beginning Containing one hundred and Ninety Eight acres Together with all and singular its appurtenances unto the said John Todd and his heirs forever, And the said Henry St. John Dixon doth for the said Thomas, Robert and Mary Todd heirs of the said James Todd deceased as Guardian as aforesaid and the said Jane Todd doth for her self and as Guardian as aforesaid for the aforesaid heirs forever every Warrant and defend the said Tract or parcel of Land unto the said John Todd and his heirs against the heirs of the said James Todd.. Subject never the less to the saving expressed in the aforesaid decree in favour of the said heirs when they shall attain their full age.
In Testimony where the said Harvey St. John Dixon and the said Jane Todd have hereunto set their hands and affixed their Seals the day and date first written.

466. Lewis SMITH, 09 Oct 1818 868 acres
467. pursuant to an order of the County Court of Washington dated 21 Jul 1818 entered in the application of said Lewis SMITH for an inclusive survey of three tracts of land containing 868 acres of land. 818 acres Lewis SMITH holds in right of his wife Catharine S. SMITH, late Catherine S. THOMPSON one of the heirs of James THOMPSON deceased conveyed to the said Catherine S. SMITH late Catherine S. THOMPSON by the legal representatives of James THOMPSON deceased by deed dated 21 Oct 1811 and 50 acres of which the said Lewis SMITH holds in his own right granted by Patent dated 20 Jun 1815. Three grants included in the 868 acres included the above 50 acres granted to the said Lewis SMITH. Another 777 acres was included within a grant for 2600 acres to James PATTON deceased dated 20 Jun 1753 which was willed to the said James THOMPSON deceased by the last Will and Testament of said James PATTON deceased dated 01 Sep 1750.     James, bought land on a branch and a main stem of the Middle Fork of the Holston /Holstein River between 1792 and 1801. He died in 1801, leaving his wife Jane and minor children, Thomas b 1796, Robert b 1798 and Mary b 1801.

    James’ son Thomas is enumerated with his mother Jane in the 1812 tax list, suggesting a birth in 1796 which fits with being the minor son of James d1801. Thomas disappears from the tax lists in 1833 when he migrated to Bartholomew County, Indiana by 1835 (according to a 1835 deed in Washington Co).

    The two Todds that seem to be Thomas’ children or adopted children are: Preston Todd b 1817 Virginia and John H. P. Todd b 1833 Virginia who lived next door to each other in Douglas Co MO in 1860. Thomas left Virginia after 1833 and was in Bartholomew County IN by 1835. Preston seems to have come with his adopted father to Indiana and married in Lawrence County in 1836. The geographic link in 1860 between Preston b 1817 and John b 1833 suggests that they are close relatives. Thomas may have had a son John H.P Todd b 1833 VA just before he left Virginia.[15]

    Preston’s military record says he was born in Russell Co Virginia in 1817. But the only family in Russell County at that time is that of James G. Todd whose descendant’s DNA does not match that of Preston. So given that Thomas Todd in 1820 census does not indicate a male child, Preston may have been born to an unwed mother in Russell Co, but been taken in as a son of Thomas thereafter. Preston’s descendants’ DNA has some similarities to the Washington Co Todds but has too many mutations to be kin.
