Records of Probate Court dated 8 Oct 1877, Setting the date for Probate of the estate of Lettie Nix dec's, John Nix and W.F. Thomas administrators. The entire document is intresting but main concern here is that on that date Thomas Nix, husband of Dicy Nix is listed as deceased. His only child is listed as dau. Zemily Nix, a minor under the age of 14 years. So we need another husband for Dicey E. Hopper aka Dicy Nix, It looks like there is a break in the birthdays of children between 1869 and 1874. So we are looking for a husband, and it would help if his surname was NIX. In fact Both John and Miles H. are listed in the Alabama Marriage records with surname NIX. Also looking for a dod for Thomas B. Nix between the Census in 1870 and this Probate Court hearing 8 Oct 1877.

At a regular term of the Honorable, the Court of Probate, held in and for said county, and State, at the Court House of said County in the City of Gadsden, on the second Monday of October, in the year of our Lord, one thousand eight hundred and seventy seven, (1877) being the Eighth (8th) day of said month, the following proceedings were had, to-wit; The Hon Lemmel(?) E. Hamlin presiding Judge.�

Lettice Nix dec'd Estate of Order Setting day

In Probate Court October 8th 1877.

John Nix and W.F. Thomas, Administrators of said estate, having this day filed their application, in writing and under oath, praying for an order, and proceedings to sell certain real estate in said petition described, of the property of said decedent at the time of her death, for division , and upon the grounds that the same cannot be equitably divided among the heirs of said estate; and appearing from an inspection of said petition----------cannot read part of the last line------, are her four children and one grandchild to-wit; the said John Nix and Frances A. Thomas wife of said W.F. Thomas, son and daughter of said decedent of full age and residing in Blount County; and Gurley T. Nix a son and Texana Nix a daughter, both between the ages of fourteen years and twenty one years and reside in Etowah County; and Zemerly Nix a grandchild and daughter of Thomas Nix deceased, who was a son of said decedent, which said Zemerly is a minor under the age of fourteen years residing with its mother, Dicy Nix in Etowah County; It is therefore, ordered, that the 19th (?) day of November 1877, be and it is hereby appointed a day for hearing the said application, and the proof which may be submitted in support of the same: It is further ordered, that said Frances A. Thomas, Gurley T., and Texana Nix have notice of this proceeding and of the day set for hearing the same, by citation to be personally served on them ten days before said day appointed for such hearing and that the said Zemerly Nix have the same notice by service of citation upon the said Dicy Nix, she having the custody of the said Zemerly Nix. It is further ordered by the court that William Harris, be and he is hereby appointed Guardian ad.litensa(?), in this proceeding for the said minor Gurley T., Texana and Zemerly Nix; the said Harris being considered by the court, as, in every respect, a fit and proper person to attend to, and to protect the interest of said minors in this proceeding. It is further ordered that said William Harris be forthwith notified of his said appointment, and of the said day set for the said hearings, that he may attend, and be prepared properly to contest the same in behalf of said minors.

THE STORY TO DATE; Tyre and Letty NIX Had five children; Thomas B., John Henry, Frances Adaline, Gurley Tillison and Texana. Tyre died in Chattanooga during the civil war and Letty raised the children until her death on 26 July 1877. By that time Thomas B. had married Dicey Ellen Hooper and they had three children, a forth would be born shortly. Also Adaline had married William F. Thomas.� On 8 Oct 1877 a hearing to set the date to hear the application to sell certain real estate was conducted by Probate Judge Hamlin. On that date The age of the various individuals can be determined by the 1870 census. Letty, died on 26 July at age 52; her children, John NIX age 24, Adaline age 22; Gurley age 19; Texana age 14. Thomas B. NIX, her oldest son would have been age 28 but the document states that he was deceased on 8 Oct 1877, and that his daughter Zemerly was living with her mother Dicey Ellen Hopper, in Etowah county. Zemerly was 7 (almost 8) on 8 Oct 1877. W.F. Thomas, Administrator of said estate (with John NIX) was William F. Thomas who had married the third child of Tyre and Letty, Frances Adaline NIX on 1 Jan 1873.�

QUESTIONS;� This document does not define "certain real estate" to be sold. That may be defined in further hearings or documents, and a determination of the legal description of the real estate would provide an understanding of where Letty and the children lived after Tyre died. Zemerly was listed and discussed as the daughter of Thomas B., and provision made to protect her part of the inheritance. However I have two additional children assigned to Thomas B. and Dicey Ellen that are not discussed. They are John age 6 and Leondus age 3, (another daughter Milas was born a few months latter.) One possible reason could be that they both had died in infancy prior to this date. Another could be that they were children by Dicey and a father other than Thomas B. I have assigned a family to John, but that was based on dates of birth and other factors. I do not have absolute positive proof that this is the correct JOHN NIX for the husband of Fanny INMAN. (I have several examples of Fanny INMAN married to A JOHN NIX, and the DoB match, so this seems a reasonable match.).��� Who is William Harris, and what is his connection,if any with this family? He was assigned the responsibility to attend to the interest of the minors in this matter. His association with the family, if any, may shine some light on the matters. ADDITIONAL RESEARCH REQUIRED; Search for the record of the hearing to determine the selling of the real estate. The date was set as 19? Nov 1877. It was not possible to read the date clearly in the original so the 19 may not be correct. However Nov 1877 was clear. That hearing may also state the legal description of the real estate. Also it may clear up additional questions, and maybe open new ones.� Do additional searching for Dicey and her family. They are listed as living in Etowah County. The loss of the 1890 census records will hamper this search somewhat, but there may be other legal documents in the Courthouse in Gadsden. Determine the identity of William Harris and his association with the family. This may be a far reach but it may provide some other areas of research.��� Review the marriage of John NIX and Fanny INMAN. Is this the correct JOHN? I think the answer is yes, this is the correct family, but then why was his interest in the inherence not discussed by the judge? Listed in the Alabama Marriage Records for 1800-1920. Thomas B. is the son of Tyre NIX and the Grandson of Jennings NIX. I am attempting to build a tree of the descendants of Jennings, and this one in particular has me a bit puzzled. I have uncovered proof that Thomas B. died "Before 8 Oct 1877". I do not have any of the details of his death, he would have been a young man, less than 28 years of age. His early death puts to question the parents of the forth child "Milly" Nix, at least on the birth day given.

I have recently found Dicey (also listed in various places as Dicie and Dicy) listed in the 1900 census ,Alabama, Etowah County, Clear Creek, 9 of 18 on <ancestry.com>. NIX, Dicie, Head, W,F, Jan 1847? 53. W. Ala,SC,SC This agrees with all of the information that I have on her. So I feel sure that I have the correct Lady. Also living with her is; NIX,Luiga, Daughter, W,F,Jan 1881,18 S, Ala, Ala, Ala NIX,Shermon,Grandson, W,M,Aug, 1899, 9/12, S, Ala, Ala, Ala The daughters name is difficult to read, and I am not sure that I got it correctly.

Golder Fields was listed on the 1812 Tax List of Warren County, Tennessee. A Golder Fields and his family are listed in 1816 Monroe County, Mississippi Territory Census. This county contained nearly half of the present state of Alabama. Indicate there were 1 male over 21 years, 1 male under 21 years, 1 female over 21 years and 3 females under 21 years. He was living next door to a Vineyard and Jessee Crawford. A John Losson is listed on the next page, about 60 families from Goulder. There were also a Samuel and Isaac Fields in this census. Were they Goulder's brothers?

The 1820 St. Clair County, Alabama Census list the following families; John Lawson, Elizabeth Lawson, Golder Fields and Major Vineyard. In Golder Fields family there is one male over 21 years, one male under 21 years, 1 female over 21 years and 5 females under 21 years.

Superior Court Minutes 1819 -1826 October Term 1824, Page 210 and 211 Golder Field assaulted John Mullins. Jury trail set for April Term 1825 and found guilty and fined $20. Page 212 John Lawson, Golder Fields and Samuel Jones (Jones late of the County of St. Clair) on the 7 October 1824 with force and angus assaulted John Mullins did beat, bruise, wound and ill treat and other wrongs to the said John Mullins then and other aid to the great damage of the said John Mullins and against the peace and dignity of the Sate of Alabama.

Next entry State vs John Lawson and Samuel Jones They pleaded not guilty. They were found not guilty.

Minutes of Circuit Court Records, page 211 Thomas R. Downing vs Daniel Lawson - Dated 11 February 1823 Daniel was charged with $200 of damage to Downing property.

Page 461 10 February 1830 State vs Golder Fields, Isaac Fields and Daniel Lawson. Charged with making thread to burn John Washburn's home and do him harm. Signed John (X) Washburn Goulder Fields, Isaac Fields, Daniel Lawson, John Langford and William Brown were fined $200 each. All were let off except Goulder Fields.

St. Clair County Court Minutes 1828 - 1849 State vs Golder Fields and Elijah Harrison - May Term 1830, page 183 and 184 This day came Aaron ready solicitor pro tem as well as Constantin Perkins who acknowledged himself held and firmly bound unto John Murphy Governor of the State of Alabama and his successor in office in the final sum of two hundred dollars ($200) to be levied of his goods and chattel land. Elijah Harrison and Golden fields acknowledge themselves hold and firmly bound unto John Murphy ���

November 1827 - Eli Wahburn and Golder Fields were on jury. Also Thomas Battles, Christopher and A. Green.

Goulder Fields is listed in the 1830 St. Clair County, Alabama Census. In the household there is 1 male 20-30 years (Goulder), 1 male under 5 years, 1 male 5-10 years, 1 male 10-15 years and 1 male 15-20 years. It also has 2 females under 5 years, 3 females 5-10 years, and one female 20-30 years.

Goulder Fields was listed in the 1840 Marshall County, Alabama Census. The following were listed in the family, males- 1-10-15 years, 1-15-20 years, 1- 50-60 years (Goulder); Females- 3-10-15 years, 1-40-50 years.

Golder and Christiann Fields were listed in the 1850 Marshall County, Alabama Census. Goulder's (Golder) age was given as 65 years and born in North Carolina. Christiann's age was given as 64 years and born in North Carolina.

"In the Northeast Alabama Settlers, Vol. 22, #1, July 1983, published in Gadsden County, AL, in an article entitled Other Families in Early St. Clair County, Alabama -- a GOULDER FIELDS is mentioned in Monroe County, Mississippi Territory, later Alabama. He was in the 1820 Census of St. Clair County, and later moved to Marshall County, The latter two counties are in the northeast section of the state, with Monroe being in the southwest, adjoining Wilcox County. Whether this is the same GOULDER/GOLDER FIELDS, who in 1816 was in the same census with JOHN LOSSON in Monroe County, is not known. But the name is unusual and we still wonder the connection of the Fields to the Lawsons -- and to GOULDER/GOLDEN -- in view of the Lawsons use of the names for children. Could both be descendants of the WILLIAM LAWSON and JOHN GOLDER who came into Maryland in 1747?"

"Joe Fields, Texas City, TX in March 1985, sent a Family Group Record for GOULDER FIELDS, which stated that an administrator of his estate was appointed 9 April 1856 in Blount County, AL. No names given for his parents, or wife. Nine children were isted, the oldest, a daughter MALINDA, born ca 1813, married LAWSON HOPPER. (I have a copy of the 1830 St. Clair County, Alabama Census and LAWSON HOPPER is listed as living next door to GOLDER FIELDS and JOHN LAWSON.) They were living in Blount Co, AL in 1856. Inquiry to Joe Fields did not elicit more information." (It would be interesting to see the document reference above and see if a Julia Ann was listed.)

Vineyard Crawford and Golder Fields were granted land in St. Clair in 1819. Goulder Fields obtained land in St. Clair County, Alabama Territory, 28 September 1819. The land was located in Township 13, Range 3E, Section 3.

I have a number of documents from St. Clair County where GOLDER FIELDS, JOHN LOSSON (LAWSON), VINYARD CRAWFORD and ROBERT LAWSON are listed on them as witnesses or involved in some type of transaction, which would indicate they knew each other. The following is a list of the documents, dates and names that we found;-

On a land transaction, dated 25 December 1823, between Elizah Harrison and William Ward, GOLDER FIELDS and JOHN LAWSON placed their marks as witness for the sale of the land. Interesting it was certified by a C. A. GREEN. (A CHRISTOPHER A. GREEN married MARY LAWSON, 6 Oct. 1825 in St. Clair County.)

In the Deed Book A, of St. Clair County, it indicates that on 2 January 1829 Goulder Fields deeded to Samuel Boyd for $570, the 40 acres of land in the W1/2 of NW1/4 Section 2, Township 13, Range 3E, including 1/2 of the spring. On the second page of this document it states "I CHRISTIAN FIELDS, wife of GOLDER FIELDS do relinquish all my right of Dower and Claim to the aforesaid Tract of Land without any fear threat or compulsion from my said husband and of my own free will in Testimony where of I have hereunto set my ha and affixed my Seal this 19th day of January 1829." The following information is from a document filed in the State of Alabama, Court of Probate, Special Term, Marshall County. On 9 April 1856, David Davidson (Goulder Fields' son-in-law) submitted letters of administration on the estate of Goulder Fields and the Court stated the letters were acceptable and Davidson was appointed administrator of Goulder's estate. The document states Goulder had been dead more than fifteen days and left no will. This would indicate Goulder died around March 1856. Davidson was authorized to sell the whole of the personal estate and pay his debts and distribute the rest to his heirs. The following is a list of the heirs in the document; 1) Malinda Hopper daughter of Goulder and wife of Lawson Hopper residing in Blount County; 2) James York and John York grand children of Goulder and children of Lucy (Lucinda) York who was deceased. James and John were residing in Tennessee. Lucinda's husband was William York; 3) Isaac Fields son of Goulder and residing in Mississippi. Isaac was married to Pamely Landthrip; 4) Louisa Harrison daughter of Goulder and wife of Aaron Harrison residing in Marshall County; 5) Nancy Davidson daughter of Goulder and wife of David Davidson residing in Marshall County; 6) Mary Buchannon daughter of Goulder and wife of Archibald Buchannon residing in Marshall County; 7) Dicy Little daughter of Goulder and wife of William Little residing in Marshall County; 8) David Fields son of Goulder and residing in Mississippi; 9) Nett Crump daughter of Goulder and wife of Samuel Crump residing in Marshall County. Each of the sons and daughters received $26.87 and the two grandchildren received $13.44 each.

The census in St. Clair County indicates Goulder had more children than was listed on the above document. Not sure why they were not included, unless they died at an early age and did not have children that would have been heirs.

There is no doubt that the census reads 10 but it could have been a mis understanding on the part of the census taker.  That would have been one heck of a burden to deposit a one year old on the door step of a 66 year old Grand Father and 62 year old Grand Mother.  Dicy was born in 1847 and would have been only 13 when Milia was born if indead she was 10 in 1870 Could it have been that Dicey had a daughter when she married Thomas B. NIX? That would explain whe she was not consider in Thomas B,'s Mothers Will.

My analysis, 1 Oct 2004:

Johnson, John W. I have his name as John William Johnson b. 8 Jan 1847 which agrees with a age of 24. M(1) I assume to mean his first marriage. Married 7 years would mean that they married in 1903 when he was 17.

Eliza, wife. I have every name in the book for this lady, but there is no doubt that they are all the same person. She has age 27, but I think she was 28 or 29 in 1910. 2 born 2 alive would mean that Sherman and Elsie were her oly two children and that she had no children by John W. Johnson. Which agrees with my current records.

Sherman was born 1899-1900

Elsie was born 1901-1902

Dicie, age 60 was born 1850, which we know to not be true, whe was born 8 Jan 1847, which would make her 64, not a big difference. She has listed 6 children born with 5 living. We know that her first born, Zemily A. Nix died so that means that I do not have one of the living children, I only have John Frank, Lee, Mily, and Louiza which is the same as Eliza. But like every thing else about this family things are not what they seem. In 1900 she list 5 children born and 5 living, I do not think it is very possible that she had an additional child between 1900 and 1910. So where do we go from here?? Maybe in 1900 she forgot about her first born , Zemily who died early. I think that DeKalb County, is a good place to look for Dicey Ellen's grave. Which would mean thaat she is not buried at SAULS and the stone there is only in memory of the entire family and may not indicate that they are all buried there.
