Will of Stephen Cox 1758
IN THENAME OF GOD AMEN I Stephen Cox of the Parish of Southam in the County of Cumberland being sick & weak in Body but of perfect sound Sense & Memory thanks be given to Almighty God and calling to Mind the Mortality of my body and believing that is appointed for all men once to die I do make this to be my last Will and testament and first I give my Soul &Body to Almighty God that gave me this Life an being to dispose of according as he in his wonderful Mercy Shall see fit and touching my Worldly Estate which it hath Pleased Almighty God to Bless me with I give and dispose of the same in the manner & form following
Imperious and first my Will and desire is that all my just Debts be Justly Paid and the remainders of my Estate I give and dispose of the same in manner and form hereafter mentioned
Item I give to my loving Brother William Cox the Plantation whereon I now Live with eight hundred Acres of Land Adjoing the same and also Thirty Pounds all which I give to him and his Heirs forever
Item I give to my loving Sister Judith Smith Thirty Pounds to her and her Heirs forever
Item I give to my loving Sister Elisabeth Clement Thirty Pounds to her and her Heirs forever
Item my Will and desire is that if my Friend Achiles Bowker has a mind to purchase the four hundred acres of Land I hold on Jase Wallit for Fifty Pounds I give my Executors full Power to make him a Deed for it otherwise the said Land shall be sold by my Executors as they see fit
Item my Will and desire is that not any part of my Estate be Appraised but remain in the Hands of my Executors till my Brother Josiah Cox comes to the age of Twenty on Years then to be equally divided to my loving Mother Judith Cox & my loving Brother Josiah Cox and my four youngest Sisters (to wit) Sarah Mary Tabitha and Martha Cox all which I give to them and their Heirs forever
Item I Constitute and appoint my loving Mother Judith Cox and my loving Brother Josiah Cox to be my hole and sole Executors to execute this my last Will and Testament Rectifying and confirming it to be my the same In Witnefs where of I have hereunto set my Hand and Seal this twelfth day June One thousand seven hundred & fifty eight

At a Court held for Cumberland County the 23rd Day of October 1758 This last Will and Testament of Stephen Cox dec'd was proved by Henry Farley and John Hubbard two of he Witnefses thereto and by the Court Ordered to be recorded and on the motion of Judith Cox Executrix therein named who made affirmation according to Law (she being a Quaker) Certificate was granted her for obtaining a Probate thereof in due From giving Security whereupon she with John Smith Bowker Smith & Francis Clemments her securities entered into Bond Recording to Law and Liberty is resumed to Josiah Cox the Executor therein named to Join in Probate
