Early Land Acquisition in Augusta County, VA

Robert Galloway's land (Borden Tract NE, 430 acres, 1741) as shown on the map meticulously drawn by J.R. Hildebrand, cartographer. This map is copyrighted©, used by permission of John Hildebrand, son of J.R. Hildebrand, April, 2009. (Note: Robert Galloway bought a 430-acre tract on Moffett's Creek from Benjamin Borden in 1741, but Borden died before conveying the deed to Galloway. Galloway then sold this tract to Joseph Kennedy sometime between 1748-54. Joseph Kennedy sold the land to his son William Kennedy in 1760, at which time William Kennedy sued his father Joseph and Borden's Executors for the deed (see "Wm. Kennedy vs. Joseph Kennedy and Borden's Executors", in the records below)).

Lease and release; for ₤6 current money. 189 acres 2 rood 10 pole, part of 92,100 acres obtained by Benjamin Burden by grant... on the north west side of Hays Creek... point of an island in the creek at a fork of the creek corner to John Hays' land... side of a dry valley... (signed) Benja. Borden. Wit: George Moffitt, Joseph Mills, George (R) Demson [Decieson?], Robt. (X) Gallay, Charles (P C) Donahee, Robert Coulton. 22 July 1742. Proved by Robt. Coulton, Chas. • Page 129.--28th January, 1748-9. John and Mary McNabb (his wife) to Arthur McClure. Mille Creek; corner James Thompson; corner Robert Galloway. Teste: Andrew McNabb, Wm. Hall, Gilbert Campbell. Delivered to John Wilson, 30th April, 1751.

• Page 203.--17th February, 1758. Colonel James Patton's estate; appraised by Thomas Stewart, John Ramsey, Edward Hall. List of bonds, bills, &c., due the estate: Page 205.-(undated, appears to be abt. 1753/54)- Robert Galloway, __ _____, ____;

• Vol. 1 - MAY, 1762 (A). - Wm. Kennedy vs. Joseph Kennedy and Borden's Executors.--In 1741 Ro. Galloway bought land of Borden, but Borden died before making deed--430 acres, Moffett's Creek. Galloway lived upon and improved the land until 12 or 13 years ago, when he sold to orator's father, Joseph Kennedy. Joseph lived on the land until 1760, when Joseph sold to William in consideration that William will pay so much, and also educate and bring up his four infant sisters. William entered, took care of his sisters, repaired the fulling mill, to do which he had to sell his own place. Writ: Feb. 25, 1759 (8?). Bill for deed from Borden.

• Vol. 1 - MAY, 1762 (A). - Kennedy vs. Kennedy.--In 1740 Robert Galloway, of Augusta, bought land from Borden, which Galloway sold to Joseph Kennedy in 1748-9, but Galloway had received no deed. In 1760 William Kennedy, son of Joseph, had four infant sisters, the oldest being 12 years old.

11 October 1770 - James Handley appeared in Botetourt County Court and he and David Galloway told the court they would pay the debts of Dennis Driskell, Robert Galloway and John Galloway or go to prison if they couldn't pay. [1]
