- ↑ I Nicholas Symons of Trenearth in the parish of Gwinear and county of Cornwall, Farmer being of sound and disposing mind, memory and understanding. Do make this my last Will and Testament in manner and form following,that is to say
First I give and bequeath unto my niece Sophia Smithram the wife of Joseph Smithram all my right title and interest of and in my premises situate at Fraddam now in the occupation of John Carne and others as tenants, for her whole and sole use and benefit and not to be under the control of her present husband or any future husband without her consent, she paying all lawful debts and demands on the said premises and her portion of court fees and expenses in proving the will. Secondly I give and bequeath unto my nephew Nicholas Brokenshire my bed and bedding, watch and wearing apparel. Thirdly I give and bequeath unto my two brothers Thomas Symons and Samuel Symons all the rest residue and remainder of my estate and effects, goods and chattels whatsoever and wheresoever and of what kind or nature soever not hereinbefore disposed of after the payment of my just debts,legacies,funeral and testamentary expenses in manner following that is to say two thirds to the said Thomas Symons and one third to the said Samuel Symons. Lastly I do here appoint my said brother Thomas Symons my whole and sole Executor and residual legater of this my last Will and Testament hereby revoking and making void all other wills and testaments by me at any time heretofore made I declare this to be my only true Will and Testament. In Witness whereof I have hereto set my hand and seal this third day of February One thousand and eight hundred and fifty three. The mark or sign of Nicholas Symons……. Signed sealed published and declared by the within named Nicholas Symons as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as Witnesses_______ William Jackson _______ Samuel Whear______ Proved 1st June 1854 in the Principal Registry of the Lord Bishop of Exeter by the Oath of Thomas Symons the sole Executor. Testator died 24th June,1853_______________________________Effects sworn under 200 pound. Ralph Barnes Dep. Registrar.
