From Montgomery County, New York, Surrogate Court Records:

1846 August 5th Martha Spire, of Amsterdam, died, leaving a will dated August 2, 1843, bequeathing all her property to my daughter Nancy Ash wife of David Ash. The will is entered for probate in 1849 at which time Nancy and David Ash list the legal next-of-kin of Martha Spire, deceased, as: Children: Nancy Ash of Amsterdam James Spier of Clay, Onandago County Richard Spire of Co Clifton Park, Saratoga County John Spire of Clifton Park, Saratoga County Grandchildren: James Spire of Peoria Illinois Hamilton and Getty Maria Bishop of Peoria, Illinois Joseph Spire of Peoria, Illinois


State of New York City and Couonty of Albany

The people of the state of New York by the grace of God free and independent, to James Spire of Clay in the county of Onondaga, Richard Spire and James Spire of Clifton Park in the county of Saratoga, James Sprie, Hamilton Bishop and Maria his wife, and Joseph Spire, all of Peoria in the state of Illinois being the heirs at law of Martha Spire, late of the town of Amsterdam in the county of Montgomery and state of New York, deceased:

   You are hereby cited and required personaly to be and appear before our county judge of our county of Montgomery, as surrogate, at his office in the village of Amsterdam, in said county, on the 10th day of March next, at 1 o'clock in the afternoon of that day, then and there to attend the probate of the last will and testament of the said Marth Spire, deceased, (which said will relates exclusively to real estate,) upon the application of David Ash and Nancy Ash, devises in said will named.
   In testimony whereof, we have caused the seal of our surrogate's court of said county to be hereunto affixed.  Witness, Samuel Belding, Jr., county judge of our county of Montgomery, at the village of Amsterdam in said county, the 17th day of January, in the year of our Lord one thousand eight hundred and forty-nine.
