Will Transcript

Martha Leckey's Will
I Martha Leckey being of sound mind but delicate health do hereby make this my last Will and Testament. It is my Will that my Executor herein after named so soon as he can conveniently after my deceas[e] make sale of all my personal property, that is not otherwise diposed of and collect all claims due me, and first pay my funeral expenses and all my past debts.
It is my will that my daughter, Agnes Leckey procure grave stones to be put up at my grave with the date of my birth and date of my death engraved thereon, the expense thereof to be paid out of my estate.
It is my Will that my executor pay to Martha Jane Leckey, daughter of my son James Leckey forty dollars in money and also give her, one feather bed with the usual bed cloathing, also one bureau.
It is my will that my Executor pay to Nathan Leckey son of my son James Leckey two hundred dollars.
I allow my Executor to place the aforesaid two hundred dollars at interest as soon as convenient after my deceas[e], and the sd. Nathan Leckey to receive the two hundred dollars with what interes[t] may be due on it, when is is twenty one years old.
It is my will that my Executor pay over to my daughter Agnes Leckey all the residue of my estate.
I hereby appoint Wm. C. Gilmore Executor of this my last Will and testament.
Given under my hand and Seal this 6th day of January 1859.

Signed, sealed and acknowledged in the presence of

At Rockbridge County Court August 1, 1859.
The last Will and testament of Martha Leckey deceased was produced in court proved by the oaths of Robert C. Sogan and John Mc Hull subscribing witnesses thereto and ordered to be recorded.
And on the motion of William C. Gilmore they executor named in said will, who made oath thereto and together with James Leckey his security (who justified as to his Sufficiency) entered into and acknowledged a bond in the penalty of one thousand dollars conditioned according to law, certificate was granted him to obtain a probat of said Will in due form. Saield? bond is ordered to be recorded.

Know all men by these presents that __ William C. Gilmore and James Lackey are held and firmly bound unto the Commonwealth of Virginia, in the ___ and full sum of one thousand dollars, to the payment whereof, well and truly to be made to the said Commonwealth of Virginia, We bind ourselves, and each of us our and each of our heirs, executors and administrators, jointly and severally, firmly by these presents. Sealed with our seals and dated this 1st day of August one thousand eight hundred and fifty nine. The condition of the above obligation is that if the said William C. Gilmore, who hath been appointed executor of the last will and testament of Martha Leckey deceased, shall tryly and faithfully discharge the duties of his office or trust according to law; then this obligation to be void, else to remain in full.
