The area reserved was 5 acres fronting Reserve Street. The Eaglehawk Old Monumental Section is laid out in orderly rectangular plats. It has all denominations and a Paupers section. There are many magnificent trees lining the roadways such as Bunya Pines, Morton Bay Figs, Oak, Hoop Pine, Canary Island Pine and Silky Oak. The first recorded burial at the Eaglehawk Cemetery is that of 21 year old John Edmond McDonough. He was interred in Grave 1 Section C on 6th July 1864. Today there is still a monument standing that was erected in his memory. There have been 6 Sextons live in the Sextons Residence formerly located near the front gates of the old monumental section. The cottage was built in the 1870's and was demolished in the 1970's.

    Vagrancy
    Two females, one with an infant in arms, of the respective names of Mary Ann Williams and Mary Ann Dutton, were charged by a person named Michael Clarke with being idle and disorderly characters, and with creating such disturbances near his residence in Great Myers-street, as ti be considered an intolerable nuisance to all the neighborhood, particularly on Saturday night last, the 15th December, when they were found brawling in the street and quarrelling with some companions of the other sex.
    Dutton stated that the other female lived with her as a nurse -girl. That on Sunday evening her husband, after having given her £3 in notes, tried to get the money back from her for the purpose of spending it in drink, which she resisting caused the brawl in the street now complained of.

    Neglected Child - Catherine Dutton, a girl eleven years old, was brought before the bench as a neglected child. Sergeant Leonard said that he found the girl in a brothel kept by a women named Kate Hedges, where were two men at the time. The mother, who had been twice committed by the bench as a vagrant, he said was in the habit of sending the child with messages to other brothels, and he considered the girl was not under proper care. The case was adjourned until Wednesday, for enquiry as to the whereabouts of the child's father.

Kate was in her mother's arms at the time of the "brawl" when she was quarrelling with her husband who wanted the £3 that he had given her earlier back. Her mother and her mothers female companion were reprimanded by the Mayor, and discharged
