Nelson, Joseph - sntered service 1780 in Augusta County, Virginia, where he resided; in Virginia regiment; granted Pension age 76 in Madison County, Alabama in 1833; addidavit made then there by Andrew Nelson (no kinship given) that he served in Revolutionary War with soldier from Augusta County, Virginia; query letter in file states soldier died 10/6/1837; query letter in file says  soldier married (1) 12/23/1771 to Catherine Barron/Bannion, Fauquier County, Virginia, also Virginia Revolutionary War soldier James Withers (died 5/4/1791 in Fauquier County, Virginia) married abt. 1765 to Elizabeth Roser/Rosser (born 8/6/1747, died 1/8/1840), also last will & testament of Revolutionary War soldier Roland Gooch probated 12/8/1794 in Louisa County, Virginia. F-S32413, R1807.
- - Note: the information contained in the query letter on file is referencing a DIFFERENT Joseph Nelson (1752-1837) of Fauquier County, Virginia, this Joseph Nelson did NOT marry Catherine O'Bannon, he married Lucy Tate.

Madison County }
On this the 21 day of August 1833 personally appeared before me Samuel Chapman,
Judge of the County Court of Madison County, Joseph Nelson a resident of said county and state, aged seventy six years, who being first duly sworn according to law, doth on his oath make the following declaration, in order to obtain the benefit of the provisions made by the Act of Congress passed June the 7 1832 — that he entered the th service of the United States under the following named officers, and served as herein stated that on the fourth day of September seventeen hundred and eighty, he joined a volunteer Company commanded by Capt. James Tate and entered the service in Augusta County Virginia where he then resided, that he marched from thence into the state of North Carolina to New Providence [now in Charlotte] where he joind Genel [Daniel] Morgan – from thence to South Carolina, to the Cowpens and was in the battle of Cowpens [17 Jan 1781] – from thence he returned to North Carolina where the company was dismissed in the last of the month of January 1781 – making a tour of five months His company officers that he now recollects were Capt. James Tate Lieut. Fulton. his field officers were Maj Trippele [sic: Francis Triplett] (Col [John Eager] Howard of the Regulars) Col. [William] Washington commander of the Light horse & Genrl. Morgan, Commander in chief. he states that for this term of service he has no documentary evidence. he states that shortly after he was dismissed Capt Tate again raised a company of volunteers. that sometime in the first of February 1781 he again joined in his company in the said County of Augusta Virginia & marched from thence to Guilford Court House North Carolina, he states that he was not in the battle at Guilford Courthouse [15 Mar 1781] – that his Capt sent him in company with some others to take care of the horses. from Guilford his Company returned to Augusta County where they were dismissed in the month of June 1781 – making a tour of four months. his field officer, in addition to those above mentioned was General Green [sic: Nathanael Greene]. he also states that he has no documentary evidence of his last service.
He hereby relinquishes all and every claim whatever to a pension or annuity except the present and declares that his name is not upon the pension roll of the agency of any state. He states that he has no documentary or other evidence of his services than the evidence of Andrew Nelson.

NOTE: Andrew Nelson deposed that Joseph Nelson was absent from home at the time of the first tour and that they were together at the Battle of Guilford Courthouse. In his affidavit in support of Andrew Nelson’s pension application (S31878), Joseph Nelson deposed that he had known Andrew Nelson since his earliest youth.
